• <br /> • <br /> UNAPPROVED <br /> • Page 3 <br /> March 24, 1997 <br /> Mounds View City Council <br /> 1 Mayor McCarty noted that this is the period of time for residents to address the Council with comments or <br /> 2 concerns on items that are not on the Agenda. <br /> 3 <br /> 4 Naja Werner,2765 Sherwood Road,stated it is her understanding that at the last meeting of the Park& <br /> 5 Recreation Committee,a member of the committee said that a flyer would be prepared and sent home with the <br /> 6 Pinewood Elementary children,urging the parents to vote on the Bel Rae matter. She wondered if it was legal <br /> 7 to use the public schools for this purpose and if it is ethical. She provided a copy of the flyer that was sent <br /> 8 home with the students. <br /> 9 <br /> 10 Ms. Trude noted that she has two children at Pinewood Elementary and she has not received the flyer. <br /> 11 <br /> 12 Mr.Floyd Olson,City Attorney,noted that Section 404 of the City Charter states that the City Council has the <br /> 13 discretion for holding Special Advisory Elections and to provide the means for holding it. That is all that is <br /> 14 referred to in the Charter,however he would assume that it would provide for consideration discretion as to <br /> 15 how to conduct the election. <br /> 16 <br /> 17 Mr. Whiting provided a copy of the flyer that was put together by the City of Mounds View and distributed to <br /> 18 the residents. Anything other than the one he identified was put together by someone other than city officials. <br /> O19 <br /> 20 PUBLIC HEARINGS: <br /> 21 <br /> 22 Public Hearing and Consideration of Resolution No.5098,A conditional Use Permit for an oversized <br /> 23 garage at 2185 Pinewood Drive. <br /> 24 <br /> 25 Mayor McCarty noted that this request had been withdrawn by the applicant. <br /> 26 <br /> 27 Public Hearing and Review of a Conditional Use Permit for on-site mobile home sales at 2075 Rustad <br /> 28 Lane. <br /> 29 <br /> 30 Mayor McCarty opened the Public Hearing at 7:22 p.m. He noted that this was not an application for a new <br /> 31 Conditional Use Permit,but rather a review of an existing Conditional Use Permit,which was extended in <br /> 32 1995. <br /> 33 <br /> 34 Mr. Jim Ericson,Planning Associate,explained that this Conditional Use Permit was originally granted in <br /> 35 February of 1995 which allowed for the onsite display and sales of model manufactured homes in the Colonial <br /> 36 Village Park. He noted the six stipulations which were a part of the Conditional Use Permit. <br /> 37 He noted that the Planning Commission and staff recommend that the CUP be reconfirmed with the same <br /> 38 stipulations. <br /> 39 <br /> 40 Tony Zook,5671 Quincy Street,stated he is concerned about the street condition on Quincy, between Hillview <br /> 41 Road and County Road 118. The residents are concerned about the heavy trucks which will be using the <br /> 42 street,causing further damage. They would like to see an additional surcharge for street maintenance for the <br /> 43 trucks that will be using the street. <br /> 44 <br /> • 45 Mayor McCarty noted that the Supreme Court of the State of Minnesota just ruled(in an Eagan case)that local <br /> 46 units of government could not apply use taxes for road construction and maintenance as it is an unauthorized <br /> 47 tax. Therefore,this would not be an option for the Council. <br /> 48 <br />
