Introduction for first reading of Ordinance No.595,An Ordinance adding day care centers and
7 group nurseries as a Conditional Use in the B-1,B-2,B-3,B-4 and I-1 Zoning Districts.
8
9 MOTION/SECOND: Trude/Quick to remove this item from the Table for discussion.
10
11 VOTE: 5 ayes 0 nays Motion Carried
12
13 Ms. Sheldon noted this ordinance would add day care centers and group nurseries as a Conditional Use in the
14 B-1,B-2,B-3,B-4 and I-1 Zoning Districts. At the present time, the City Ordinance allows for day care
15 centers and group nurseries in the residential district. This would add them to the business and industrial
16 district. She noted that two issues of concern addressed at the February 24th Public Hearing were the higher
17 level of exhaust fumes for children of day care centers located in areas of higher traffic volumes, and whether or
18 not a distance requirement should be established between day care centers/group nurseries and businesses
19 serving liquor, liquor stores and adult establishments.
2011111
21 With respect to vehicle fumes,Ms. Sheldon noted that the City's ordinance does require that day care
22 centers/group nurseries be located on arterial or collector streets rather than local streets(she believes this was
23 to try to keep heavier traffic out of the residential neighborhoods). In talking with the Air Pollution Control
24 District,it was their estimate that with a 200 foot distance between the play area and the traffic/intersection,
25 sufficient disbursal of the fumes would eliminate the hazard. Therefore,it would be Ms. Sheldon's
26 recommendation that a criteria be added to require that the play area be at least 200 feet from the right of way
27 of Highway 10.
28
29 In regard to distance requirements, criteria could be added to state that a 500 foot distance is needed between
30 any day care center/group nursery from establishments have either a liquor license or licenses for adult
31 businesses. Ms. Sheldon noted that the distance requirements could be adopted for just the business and
32 industrial district,or could also be added to the residential districts, with a provision that existing day care
33 centers will not be made non-conforming. She noted that the criteria proposed would not apply to home day
34 care.
35
36 MOTION/SECOND: Trude/Koopmeiners to Approve the Introduction of Ordinance No. 595,An Ordinance
37 adding day care centers and group nurseries as a conditional uses in the B-1,B-2,B-3,B-4 and I-1 zoning
38 districts,Option#2,and to waive the reading.
39
40 ROLL CALL VOTE:
41
42 Mayor McCarty aye
43 Council member Koopmeiners aye
44 Council member Quick aye
45 Council member Trude aye
111111
46 Council member Stigney aye
47
48 Motion Carried(5-0)
