City of Mounds View Staff Report <br /> Resolution No. 5106, Authorization to Abate 2349 Laport Drive <br /> April 11, 1997 <br /> Page 2 <br /> (3) Section 607.03, Subd. 3e: "The depositing of maintaining,permitting or failing to <br /> remove, garbage, trash, rubbish, bottles, cans and other refuse on any property within <br /> the City, including large quantities of organic debris materials, which accumulated by <br /> other than natural means, except properly maintained compost piles." <br /> (4) Section 607.06, Subd. 3c1: "Vehicles which are parked or stored outside shall be on <br /> an improved surface as defined in this Code." <br /> (5) Section 607.06, Subd. 6a: "Abandoned and junk vehicles are declared to be a public <br /> nuisance creating a hazard to the health and safety of the public because they invite <br /> plundering, create fire-hazards, attract vermin, and present physical dangers to the <br /> safety and well-being of children and other citizens." <br /> (6) Section 607.06, Subd. 6d: "Any vehicle shall be deemed to be a junked or abandoned <br /> vehicle if said vehicle does not have attached thereto a valid and current license plate <br /> issued by the proper State agency." <br /> Numerous letters have been sent to the Lodmills regarding these violations. The most recent of <br /> these letters dated March 25, 1997 and April 2, 1997 are attached for the Council's reference. <br /> 4111 <br /> Staff has extended previous deadlines to have the orange truck removed (by April 15, 1997) and <br /> the junk, debris and brush accumulations (by May 1, 1997.) <br /> The process for abating properties is addressed in Section 607.08, Subdivision 1. It states that if, <br /> upon the judgement of the enforcement official, nuisance conditions are being maintained or exist <br /> within the City, a notification shall be sent or delivered to the person(s) committing and <br /> maintaining such nuisances. The notification shall require the person(s) to correct the violations <br /> within a reasonable period of time, not to exceed 30 days. If corrective actions are not taken <br /> within the specified period, the City Council may authorize abatement. The person(s) shall be <br /> notified at least ten days in advance of the Council meeting and be given an opportunity speak <br /> before the Council.
