APPROVED <br /> Page 4 <br /> May 27, 1997 11111 <br /> Mounds View City Council <br /> Chad Harris,2085 Terrace Drive,stated he purchased his Mounds View home on January 6, 1997. The <br /> property was inspected on December 27, 1996 by City Inspector Rick Jarson. After having a number of <br /> problems with moisture build-up on his roof and leaks,he has been told by various contractors that his roof is <br /> not up to code. He has talked with Mr.Jarson in regard to these problems. Mr.Harris stated he would like <br /> an official response from the city as to when he can expect this problem to be resolved. He noted that he <br /> spoke with the League of MN Cities Representative,Bob Weisbrode,who is doing some research to see if the <br /> city is liable. <br /> In response to Mr.Harris'comments,Attorney Bob Long explained that there is a statute on the books which <br /> holds cities harmless on inspections,due to the fact that inspectors are not always able to spot <br /> problems at the time of inspections. He talked with Mr.Fred Drive from the State Department Building Code <br /> and Rick Jarson is currently in the process of preparing a corrective letter to the previous owners,based on his <br /> re-inspection on May 14, 1997,where he will outline the areas on non-compliance. The corrective order will <br /> give the previous owners 30 days to bring the property into compliance or he will be in violation of the code, <br /> which is a misdemeanor offense. The city will keep Mr.Harris informed as to the status. <br /> PUBLIC HEARINGS: <br /> There were no Public Hearings scheduled for this meeting. <br /> COUNCIL BUSINESS: S <br /> A. Consideration of Resolution No.5127,Approving a General Concept Plan to Allow Development of <br /> Commercial and Residential Uses at 2704-2740 Highway 10 and 7801 Silver Lake Road. <br /> B. Consideration of Ordinance No.599,an ordinance approving a rezoning from B-2 to Planned Unit <br /> Development (PUD)for mixed uses for property located southeast of Highway 10/Silver Lake Road <br /> intersection(2704-2740 Highway 10 and 7801 Silver Lake Road) <br /> Ms. Sheldon,Director of Community Development noted that the Pubic Hearings for these requests were held <br /> on May 12, 1997 and this will be the second reading on Ordinance No.599. She explained that the owners, <br /> D.W.Jones,Inc.and Five D Limited,are asking for approval of a rezoning of property from B-2 to PUD for <br /> both commercial and residential uses. The type of uses which are included in their proposal are a gas <br /> station/convenience market,fast-food restaurant,carwash,sit-down style restaurant,83 unit senior housing <br /> complex and one-story office building. She noted that if the City Council agrees with the general concept plan <br /> and layout,they should approve Resolution No.5127 and then consider the Ordinance change. <br /> Ms. Sheldon went through the issues which were outstanding at the time of the council's last meeting in regard <br /> to the general concept plan. She explained what the developers have done to satisfy the concerns raised at the <br /> last meeting on issues related to the wetlands,traffic,drainage system,underground parking,and the site design <br /> and design theme along Highway 10. <br /> Ms. Sheldon noted that all of the uses which have been proposed for the site do fit within the city's <br /> comprehensive plan and the marketing study that was done. However,in order to allow for this proposed <br /> development,rezoning of the property is required. <br /> Ms. Sheldon explained that the Urban Designer that they worked with provided some suggestions in regard to 11 <br /> how to pull the site together and provide a better layout.
