CITY OF MOUNDS VIEW <br /> COUNTY OF RAMSEY <br /> STATE OF MINNESOTA <br /> RESOLUTION NO. 5136 <br /> ORDERING THE ABATEMENT OF HAZARDOUS CONDITIONS EXISTING AT 2091 <br /> HILLVIEW ROAD IN THE CITY OF MOUNDS VIEW <br /> WHEREAS, the Building Official of the City of Mounds View has determined that the <br /> building at 2091 Hillview Road in the City of Mounds View constitutes a hazardous building <br /> within the meaning of Minnesota Statutes, Section 463.15, Subd. 3; and <br /> WHEREAS, based on the investigation of the Building Official it is recommended that <br /> the hazardous building be razed and removed; and <br /> WHEREAS, Minnesota Statutes, Section 463.161 authorizes the governing body of any <br /> City of town to correct or remove the hazardous condition of any hazardous building or property; <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Mounds <br /> View as follows; <br /> • <br /> 1. The City of Mounds View finds that the building located at 2091 Hillview Road <br /> in the City of Mounds View legally described in the attached Abatement Order is a hazardous <br /> building within the meaning of Minnesota Statutes, Section 463.15, Subd. 3. <br /> 2. The hazardous building at the foregoing address also constitutes a public <br /> nuisances within the meaning of Minnesota Statutes, Section 561.01, 561.02. <br /> 3. An Abatement Order substantially similar to that attached hereto shall be served <br /> upon all required parties in order to effectuate this resolution and remove the hazardous building <br /> on the property. <br /> 4. The City Attorney is authorized to take all necessary legal steps to secure <br /> compliance with the Order and to obtain authority to remove the hazardous building by court <br /> order or consent and assess the costs thereof against the property. <br /> Dated this 23rd day of June, 1997, by the City Council of the City of Mounds View. <br /> ATTEST: <br /> Duane McCarty, Mayor <br /> (SEAL) <br /> Chuck Whiting, City Administrator <br />
