3. Hanunerschmidt shall make recommendations to the City Clerk-Administrator and the <br /> City Council for hiring personnel and will train the personnel necessary to successfully <br /> maintain and operate The Bridges. Hammerschmidt agrees to comply with all applicable <br /> federal, state and local laws, resolutions, ordinances, rules, regulations, and executive <br /> orders pertaining to unlawful discrimination on account of race, color, creed, religion, <br /> national origin, sex, marital status, disability, age, or status with regard to public <br /> assistance. Hannlnerschmidt shall establish and maintain a procedure to discipline <br /> employees for cause in compliance with the City's personnel regulations_ <br /> 4. Hammerschmidt shall supervise, manage, and oversee the day-to-day operations of The <br /> Bridges, including, but not limited to, overseeing the maintenance of the golf course and <br /> its buildings and equipment, scheduling the hours of operation of the golf course, and <br /> determining the day-to-day operating procedures of the golf course. <br /> 5. Hammerschmidt shall make every effort to keep the golf course open for play at all times. <br /> The closure of the golf course because of severe weather, for the purpose of performing <br /> improvements, or for any other reason shall be at Hamrnerschmidt's discretion, and <br /> Hammerschmidt shall be responsible for providing reasonable notice to the City of the <br /> necessity of closing the golf course and the reasons therefor. <br /> 6. Hammerschmidt shall develop and maintain systems to ensure the proper maintenance of <br /> facilities and equipment. The City reserves the right to inspect the facilities and <br /> equipment at least quarterly to insure that it is being properly maintained. <br /> 7. Hammerschmidt shall oversee the grounds maintenance on all greens, tees, fairways, • <br /> roughs, driving range,clubhouse lawn, and all other turf area within the boundaries of the <br /> golf course property. Such maintenance shall be maintained at a level that equals or <br /> exceeds the maintenance standards as set forth in Exhibit A. The City reserves the right <br /> to reasonably modify the minimum maintenance standards in order to comply with any <br /> present or future laws or regulations. <br /> 8. Hammerschmidt shall operate and maintain the golf course in accordance with all federal, <br /> state, and local laws, regulations,and ordinances and City policies_ Hammerschmidt will <br /> obtain all permits, licenses, and certifications necessary to ensure compliance with all <br /> federal, state, and local laws, regulations, and ordinances. <br /> 9. Hammerschmidt shall promote The Bridges, and advertising will be considered a separate <br /> line item in the budget. Any increase over the approved budget for advertising must be <br /> approved in writing by the City. <br /> 10. Hammerschmidt shall develop and maintain systems to insure adequate internal controls <br /> and accurate and timely reporting of financial information. Such systems are subject to <br /> the review and approval of the City's Finance Director. <br /> 11.
