Item No. I l E
Staff Report No. q'7- ZZ! C.
Meeting Date: September 22, 1997
• Type of Business: CB
WK:WorkSession;PH:Public Hearing;
CA:ConsentAgenda;CB:Council Business
City of Mounds View Staff Report
To: Mayor and City Council
From: James Ericson, Planning Associate
Item Title/Subject: Second Reading and Consideration of Ordinance No. 603, an
Ordinance Amending Section 1005.12 of the Mounds View
Municipal Code Entitled"Housing Code".
Date of Report: September 19, 1997
Background:
This ordinance amendment was before the Council on September 8, 1997 for its first reading.
Jennifer Bergman, the City's former Housing Inspector, made the presentation. This amendment
has been prompted by the number of owner-occupied multiple family dwellings that because of
how they are definied in the Housing Code, would require them to be inspected. The intent of
this program was to inspect rental multiple family units, not owner-occupied housing. At the May
• worksession, Council directed staff to dratf and ordinance that would remove the requirements of
registration from all owner-occupied dwelling units.
Analysis:
Currently the Code requires the City to inspect all multiple family buildings. "Multiple Dwelling"
in the Housing Code is defined as"a building or portion thereof containing two (2) or more
units." By this definition, all duplexes, twin homes, townhomes and condominiums would be
required to be inspected and registered anually regardless of whether they were owner-occupied
or not. In order to limit the inspections and registrations to only those units which are renter-
occupied, Ordinance 603 states that"Multiple Dwelling"be defined to include the definitions of
"Dweelling, Multiple" and"Dwelling, Two-Family" as listed in Sections 1102.36 and 1102.339 of
the Zoning Code. (These definitions are attached for your reference.) By adding these
definitions to the registration reqiuirements, the ordinance would include all rental units in
buildings with two or more units, but exclude the owner-occupied townhomes, condominims, and
duplexes units. The ordinance also states that the registration and inspection requirements apply
only to non owner-occupied units.
Recommendation:
Adopt Ordinance No. 603, an ordinance amending Section 1005.12 of the Mounds View
Municipal Code.
James Ericson, Planning Associate
