A dog under control solely by mens <br /> of command or signal shall be considered under control only if in <br /> the presence of the owner or some other person of suitable age <br /> and discretion, and on the owner's premises or the premises of <br /> another who has given consent to the owner. Any dog off the <br /> premises and not on a leash, cord or chain, not more than six <br /> feet (6' ) in length or not confined in an enclosure designed to <br /> appropriately restrict or prevent escape. The dog handler must <br /> be of sufficient age to adequately control the dog. <br /> b. DOG KENNEL: <br /> (1) Residential : Any premises where more than two (2) dogs but <br /> not more than four (4) dogs over six (6) months of age are owned, <br /> boarded, bred or offered for sale . <br /> (2) Commercial : Any premises where more than four (4) dogs over <br /> six (6) months of age are owned, boarded, bred or offered for <br /> sale. <br /> c. OWNER: Any person, firm, partnership or corporation owning, <br /> harboring or keeping a dog. <br /> d. VICIOUS DOG: One that is habitually unruly and untamed, or one <br /> that is a general public nuisance. (Ord. 460, 4-24-89 ; 1993 Code) <br /> Subd. 2 . Cruelty to Dogs: Minnesota Statutes sections 343 . 20 to <br /> and including 343 . 37 are hereby adopted by reference and shall be <br /> in full force and effect in the City as if set out here in full . <br /> Subd. 3 . Licensing and Tags : <br /> a . License Required; Fee Established: No dog owner shall keep any <br /> dog over six (6) months of age within the Municipality unless a <br /> license has been issued by the Clerk-Administrator for a fee <br /> established by City Council resolution. License shall be renewed <br /> biennially. The fee for licenses obtained for a period of one <br /> year or less shall be one-half C/2) of the above fees. <br /> b. Rabies Inoculation Certificate: A certification from a <br /> veterinarian shall accompany an application indicating the <br /> following : <br /> ( 1) That the dog has been inoculated for rabies within two (2) <br /> years from the date of application. <br /> (2) That said dog has been spayed or neutered, when a license is <br /> being sought for a spayed female or neutered male. <br /> c. Expiration: All licenses issued under this Chapter shall <br /> expire on September 31 of the year of their expiration. <br /> d. Payment of Fee : It shall be the duty of each owner of a dog to <br /> 1 . See also subdivision 701 . 03 (15) of this Code. <br />
