Trude stated that she <br /> 6 would like more public input. Trude also stated that the City could <br /> 7 deny a permit in a wetland and the City would end up defending <br /> 8 itself in court. <br /> 9 <br /> 10 Mayor Linke stated that if the developer/resident passed our wetland <br /> 11 ordinance, they would pass Rice Creek Watershed's. Linke stated <br /> 12 that the City' s is stricter. Mounds View's Wetland Ordinance is the <br /> 13 strictest in the metro area and Linke stated that he believed, in <br /> 14 the state. <br /> 15 <br /> 16 Councilmember Trude stated that if the City were to deny a permit, <br /> 17 then there could be a lawsuit. <br /> 18 <br /> 19 Mayor Linke stated that the City has denied permits and that the <br /> 20 developer then reconfigured the work and met the code requirements. <br /> 21 <br /> 22 Councilmember Trude asked what the driving force was behind the <br /> 23 City rushing into the permitting. <br /> 24 <br /> 25 Mayor Linke indicated that this permitting policy has been talked <br /> 26 about for the past three years. <br /> 27 <br /> 28 Councilmember Trude stated that the last work session was the first <br /> 29 time that she had heard about it. <br /> 30 <br /> 31 Councilmember Wuori explained that the recommendation by staff is to <br /> 32 approve a contract with SEH to proceed with developing a permitting <br /> 33 policy. Wuori stated that there would be time to hold a public <br /> 34 hearing to get public input. Wuori noted that there wouldn't be any <br /> 35 type of policy to adopt before this Fall . <br /> 36 <br /> 37 Councilmember Trude suggested the ordinance amendments be made and <br /> 38 then the City should look at making a decision regarding the <br /> 39 permitting process. Trude stated that there are a lot of people <br /> 40 that would watch this issue very carefully in the City. <br /> 41 <br /> 42 Samantha Orduno, City Administrator, stated that at the meeting <br /> 43 Rocky Keene, SEH, stated that Tasks 1 through 3 could be completed <br /> 44 and if, at that time, the City wanted to go on to the Final Permit <br /> 45 Forms and Information Package for a cost of $8, 000 they could. <br /> 46 <br /> 47 Councilmember Trude asked that at what point did staff discuss this <br /> 48 permitting policy. <br /> 49 <br /> 50 Orduno responded that the permitting policy was totally discussed at <br /> 51 meeting by the City Council . <br /> 52 <br /> 53 <br /> 54 <br />
