Consideration of Contract with SEH for Storm Water Management <br /> 6 Permitting Policy <br /> 7 <br /> 8 Samantha Orduno, City Administrator, reported that Rocky Keene, <br /> 9 SEH, presented a schedule for assuming the permitting authority of <br /> 10 surface water issues to Council at their July 6, 1994 Work Session. <br /> 11 Orduno stated that the presentation included the necessary steps to <br /> 12 be taken to accomplish this policy accompanied by a fee schedule for <br /> 13 performing those tasks. Orduno explained that one of the tasks to <br /> 14 be performed is to ensure that the current plan is in compliance <br /> 15 with all laws and regulations of the Wetland Conservation Act. <br /> 16 <br /> 17 Councilmember Trude stated that at the Work Session the discussion <br /> 18 involved having the City bring the ordinances up to date and she <br /> 19 didn't realize that this meant that the City would rush into the <br /> 20 permitting process. Councilmember Trude raised some concerns <br /> 21 regarding this issue, i . e. , does the City have adequate staff to <br /> 22 handle the additional process? Trude also stated that the Rice <br /> 23 Creek Watershed District has an engineer and the City doesn't. This <br /> 24 would require that the City have the consulting engineer involved <br /> 25 with each permit when the Rice Creek Watershed District has an <br /> 26 engineer which would be covered by the Rice Creek Watershed taxing <br /> 27 district. Trude commented that the City would recover some costs by <br /> 28 charging for the permits, but many of those permits are only $10. 00. <br /> 29 <br /> 30 Mayor Linke stated that the City' s wetland ordinance is more strict <br /> 31 than that of Rice Creek Watershed District. Mayor Linke stated that <br /> 32 now the resident or developer has to go through the same process <br /> 33 twice, once with the City and once with Rice Creek Watershed <br /> 34 District and, if the City takes over the permitting process, the <br /> 35 resident or developer would only _have to go through the process one <br /> 36 time. <br /> 37 <br /> 38 Councilmember Trude asked if the City requires soil borings. <br /> 39 <br /> 40 Mayor Linke responded that the soil borings are done by the <br /> 41 developer and all data is provided to the City's consultant. Mayor <br /> 42 Linke commented that this has been the standard procedure. Mayor <br /> 43 Linke stated that he is not aware of any case where a resident has <br /> 44 had to do soil borings. The contractor normally would do the soil <br /> 45 borings because the contractor would have to find out what the <br /> 46 footings are being put on. <br /> 47 <br /> 48 Councilmember Trude stated concerns as to adding additional stress <br /> 49 to the staff by the City taking over the permitting process. <br /> 50 Trude stated that she understood the City was talking about SEH <br /> 51 bringing ordinances up to date, but didn't know that the City was <br /> 52 taking over permitting. Trude also expressed concern that there was <br /> 53 an environmental issue which would conflict with the City taking <br /> 54 over the permitting. Trude stated that the City would not be as <br />
