Mounds View City Council Page 6 <br /> Regular Meeting November 29, 1994 <br /> 1 MOTION/SECOND: Wuori/Trude to Adopt Resolution No. 4670 Approving <br /> 2 a Conditional Use Permit for Dennis Patterson, 8121 Edgewood Drive, <br /> 3 to Allow for the Construction of an Oversized Accessory Building <br /> 4 <br /> 5 Councilmember Trude asked if there had been an on-site inspection. <br /> 6 Harrington affirmed there had been. <br /> 7 <br /> 8 VOTE: 5 ayes 0 nays Motion Carried <br /> 9 <br /> 10 Consideration of Request for a Wetland Alteration Permit, for Louis <br /> 11 Downing, Woodale and Longview <br /> 12 <br /> 13 Mayor Linke opened the public hearing at 7: 15 p.m. <br /> 14 <br /> 15 Paul Harrington, Community Development Coordinator, explained that <br /> 16 Louis Downing, the owner of Lot 2 , Block 1 of Downing Addition, has <br /> 17 made application for a Wetland Alteration Permit. Mr. Downing is <br /> 18 in the process of selling this property to a potential buyer based <br /> 19 on whether the lot is buildable or not. The Wetland Zoning <br /> 20 Ordinance requires that a Wetland Alteration Permit be issued for <br /> 21 the construction, alteration, or removal of any structure in or <br /> 22 upon a Wetland Zoning District. Mr. Downing's property is <br /> 23 primarily within the Wetland Buffer Zone, which is a 100 foot strip <br /> 24 that surrounds the wetlands. The City has a controlling interest <br /> 25 in those Buffer Zones because of the potential impacts on the <br /> 26 wetlands themselves. In Mounds View, those wetlands are used for <br /> 27 storm water retention and detention and they play an important role <br /> 28 in the storm water management plans of the City. For that reason, <br /> 29 a public hearing is required. <br /> 30 <br /> 31 Harrington said this item had been reviewed by himself as well as <br /> 32 by Rocky Keene, the City Consulting Engineer, for compliance with <br /> 33 the Municipal Code. Harrington commented that the City Consulting <br /> 34 Engineer did not see a problem with the home being constructed on <br /> 35 the property. It should not adversely affect the wetland itself. <br /> 36 However, the applicant has indicated on a site plan some additional <br /> 37 landscaping and clearing of the property and installing of sod. <br /> 38 Harrington and the City Consulting Engineer both felt that would <br /> 39 not be in the best intentions of the Code. He explained that the <br /> 40 Code does not encourage the elimination of natural vegetative cover <br /> 41 in the areas of wetlands and that includes the Buffer Zones. <br /> 42 <br /> 43 Harrington said that he and the City Consulting Engineer had <br /> 44 reviewed the issues of storm water runoff and the impacts to the <br /> 45 wetland. With the use of an overhead projector, Harrington <br /> 46 presented a map which indicated the location of the property at <br /> 47 Longview and Woodale Drive, noting that the map had been forwarded <br /> 48 to him by the prospective buyer and not by the applicant. This map <br /> 49 showed the proposed location of the home in relation to the wetland <br /> 50 and the 100 foot Wetland Buffer Zone. He pointed out that the City <br />
