Exhibit 2 2-year performance bond in the amount of <br /> as required by Chapter <br /> 1302 of the Municipal Code. <br /> Exhibit 3 Additional stipulations <br /> Wherever the words "public improvement" appear herein, it shall <br /> mean any improvement defined under Chapter 202 . 05, Subd. 1, of <br /> the Municipal Code, and shall include and not be limited to <br /> streets, curbs and gutters, sanitary sewer and water <br /> installations, storm water and drainage installations. <br /> 2 . This document shall be referred to as the <br /> "Development Contract" , and said document cannot be transferred <br /> or assigned by the Developer except and with the written permis- <br /> sion of the City, granted pursuant to a resolution of the City <br /> Council. <br /> 3 . All improvements required herein to be performed by <br /> the Developer shall be constructed and paid for by said Developer <br /> pursuant to appropriate permits and approval from any <br /> governmental agency, such approval and any environmental assess- <br /> ments or environmental impact statements required to be obtained <br /> by and prepared at the expense of said Developer. <br /> 4 . All public improvements required to be constructed <br /> by the Developer pursuant to this Agreementshall be performed by <br /> the Developer with such materials and equipment as required by <br /> the City under the direct supervision of the City and shall be in <br /> conformance with any and all regulations in force at the time of <br /> construction, and the City is hereby granted the right of access <br /> 2 <br />
