RESOLUTION NO. 4832 <br /> CITY OF MOUNDS VIEW <br /> COUNTY OF RAMSEY <br /> STATE OF MINNESOTA <br /> RESOLUTION DENYING REZONING REQUEST BY <br /> GARY KRIG/FRAN DEGROSS, PLANNING CASE NO. 422-95 <br /> WHEREAS, Gary Krig and Fran Degross have made application to <br /> rezone the property located at 5497 Adams Street from B-2 , Limited <br /> Business to B-3 , Highway Commercial; and <br /> WHEREAS, the property is legally known as: <br /> The West 54 feet and the South 16 feet of Lot 1, Block 4 and; the <br /> East 30 feet of the North 1/2 of Lot 4 , Block 4 and; all of Lot <br /> 2 , Block 4 ; All in Spring Lake Park Highlands; and <br /> WHEREAS, Chapter 1125. 01, Subdivision 1(e) of the Mounds <br /> View Municipal Code provides that the City Council shall consider <br /> possible adverse effects of the proposed amendment. It further states <br /> that judgement shall be based upon, but not limited to, the following <br /> factors: <br /> 1. Relationship to Municipal Comprehensive Plan <br /> 2 . The geographical area involved <br /> 3 . Whether such use will tend to or actually depreciate <br /> the area in which it is proposed <br /> 4 . The character of the surrounding area <br /> 5. The demonstrated need for such use; and <br /> WHEREAS, the Mounds View City Council has reviewed the <br /> request in relation to the aforementioned criteria; and <br /> WHEREAS, the rezoning request is inconsistent with the <br /> City 's Comprehensive Land Use Plan designation for this property which <br /> is Limited Business. <br /> NOW, THEREFORE, BE IT RESOLVED that the Mounds View City <br /> Council denies the request to rezone the property legally known as: <br /> The West 54 feet and the South 16 feet of Lot 1, Block 4 and; the <br /> East 30 feet of the North 1/2 of Lot 4, Block 4 and; all of Lot <br /> 2 , Block 4 ; All in Spring Lake Park Highlands <br /> from B-2 , Limited Business to B-3 , Highway Commercial due to its <br /> inconsistency with the Mounds View Comprehensive Land Use Plan <br /> designation for the property. <br /> Adopted this 23rd day of October, 1995. <br /> ATTEST: <br /> Mayor <br /> (SEAL) <br /> Clerk-Administrator <br />
