STAFF REPORT <br /> PAGE TWO <br /> OCTOBER 18, 1995 <br /> If the City Council chooses not to reconsider its September 11, <br /> 1995 decision, staff recommends that the City Councilmembers who <br /> do not support the conditional use permit amendment indicate the <br /> basis for their decision. Staff's review of the background of <br /> the matter indicates that the objections to the amendment <br /> included the following items: <br /> 1. Expanding the hours of operation to 24 hours would <br /> create additional noise and disturbance to the adjacent <br /> residential neighborhood. <br /> 2 . Expanding the hours of operation would create potential <br /> safety problems, primarily because there would be no <br /> attendant on duty at all times <br /> 3. There have been no changed circumstances since the <br /> conditional use permit was originally issued that would <br /> support an amendment to the hours of operation <br /> limitation. Economic considerations of the business, <br /> by themselves, are not a sufficient reason to justify <br /> the amendment. <br /> 4. The applicant's business is different that the "Wash <br /> Me" Car Wash because the applicant's business abuts <br /> single family residential property, whereas the "Was <br /> Me" Car Wash abuts industrial property. <br /> 5. The applicant's business is different that the FINA Car <br /> Wash because the FINA Car Wash does not abut single <br /> family residential property and because the FINA Car <br /> Wash is operated in conjunction with a 24 hour <br /> convenience store that has employees on duty 24 hours <br /> per day. <br />
