'. . IU. l_su.. •----- •.-'- •-- -" <br /> SUMMARY; <br /> This matter was considered by the City Council at its September 11, 1995 <br /> meeting. The applicant requested an amendment to the conditional use <br /> permit that was originally issued in 1985. The amendment would have <br /> allowed the car wash to remain open 24 hours and to have an attendant on <br /> duty for only four hours a day. The original conditional use permit <br /> required that an attendant be on duty at all times and restricted the <br /> hours of operation to a maximum of 7: 00 a.m. to 10:00 p.m. <br /> At the September 11, 1995 meeting the City Council approved the <br /> applicant's request so that an attendant only had to be on duty for four <br /> hours a day but denied the applicant's request to remain open 24 hours <br /> per day. <br /> Subsequent to the September 11, 1995 meeting, the City Attorney received <br /> a letter from the attorney for the applicant. A copy of that letter is <br /> attached. The City Attorney and the applicant's attorney have also <br /> discussed the matter. The applicant's attorney has requested to be <br /> provided with an opportunity to address the City Council to request <br /> reconsideration of the City Council's decision. <br /> The City Attorney will be at the Council meeting to answer any questions <br /> that the City Council may have on this matter. He has advised staff <br /> that the City Council's decision on whether to allow an amendment to the <br /> conditional use permit is a discretionary matter. If the Council wants <br /> to reconsider this matter, it may do so by a motion made by one of the <br /> Councilmembers who voted against the motion extending the hours of <br /> operation t• sours. <br /> Pa -arrington, Commu y Development Coordinator <br /> RECOMMENDATION; <br />
