12. "Drug" - a controlled substance. <br /> 13. "Federal Highway Administration(FHWA)" -the federal agency responsible for <br /> promulgating the rules pursuant to which this policy is adopted. <br /> 14. "Medical Review Office (M.R.O.)"is a licensed physician responsible for receiving <br /> laboratory results generated by the employers drug testing program and who has <br /> knowledge of substance abuse disorders and has appropriate medical training to interpret <br /> and evaluate an individual's positive test result together with employee's medical history <br /> and any other relevant biomedical information. (Subpart 40.3). <br /> 15. "Performing A Safety Sensitive Function_'_a driver-isconsidered to-be-performing-a <br /> safety sensitive function during any period in which the driver is actually performing, <br /> ready to perform, or immediately available to perform, or in a state of readiness to <br /> perform any safety sensitive function while on duty. (382.107). <br /> 16. "Random Selection"means a mechanism for selection of employees for testing where <br /> each employee has an equal chance of being tested each time selections are made. <br /> (382.107). <br /> 17. "Reasonable Suspicion"means that a City believes the appearance, behavior, speech or <br /> body odors of a driver are indicative of the use of a controlled substance or alcohol based <br /> on the observation of at least one (1) supervisor or official who has received training in <br /> the identification of behaviors indicative of drug and alcohol use. "Refusal to Submit(to an alcohol or a controlled substance test)" a driver <br /> (3 82.107) <br /> (A) failure to provide adequate breath for testing without a valid medical explanation <br /> after the driver has received notice of the requirement for breath testing in <br /> accordance with the provisions of this policy; <br /> (B) failure to provide adequate urine for controlled substance testing without a valid <br /> medical explanation after the driver has received notice of the requirement for <br /> urine testing in accordance with the provisions of this policy and federal <br /> regulation; or <br /> (C) engaging in conduct that clearly obstructs the testing process. <br /> 19.
