Conduct Related to Controlled Substances <br /> 1. Drivers shall refrain from taking non-prescription or prescriptive drugs that would impair <br /> their ability to perform their job safely. Taking of such drugs does not automatically <br /> exclude the driver from reporting for duty, except when instructed by a physician who <br /> has advised the driver that the substance adversely affects the driver's ability to safely <br /> operate a Commercial Motor Vehicle. A driver shall notify his/her supervisor when <br /> taking prescription or non-prescription medications that may lead to impairment. <br /> 2. The City having actual knowledge that a drive has used a controlled substance, shall not <br /> permit the driver to perform or continue to perform a safety sensitive function unless use <br /> is permitted pursuant to the written instruction of a physician. <br /> 3. The City, having actual knowledge that a driver has tested positive for controlled <br /> substances, shall not permit the driver to perform or continue to perform safety sensitive <br /> functions. <br /> 4. A driver shall inform the driver's supervisor of any therapeutic drug use. <br /> 5. No driver shall report for duty, remain on duty, or perform a safety sensitive function, if <br /> the driver tests positive for controlled substances. <br /> 6. No driver shall refuse to submit to a post-accident controlled substance test, a random <br /> controlled substance test, a reasonable suspicion controlled substance test mandated by <br /> this policy and federal law. <br /> 7. The City shall not permit a driver who refuses to submit to the mandated controlled <br /> substance tests to perform or continue to perform safety sensitive functions. <br /> 8. A driver shall not report for duty, remain on duty, or perform a safety sensitive function, <br /> if the driver tests positive for controlled substances. <br /> 9. No driver shall not refuse to submit to a post-accident controlled substance test, a random <br /> controlled substance test, a reasonable suspicion controlled substance test_mandated by <br /> this policy and federal law. <br /> PERSONS SUBJECT TO TESTING <br /> The Omnibus Transportation Employee Testing Act, requires that all employees whose job <br /> duties include the operation of a commercial motor vehicle and who are required to hold a <br /> commercial driver's license (CDL), shall be subject to drug and alcohol testing. "Commercial <br /> Motor Vehicle" (CMV) means a motor vehicle or combination of motor vehicles used to <br /> transport passengers or property if the motor vehicle meets any one of the following criteria: <br /> a) has a gross combination weight rating of 26,001 or more pounds; or <br /> b) has a gross combination weight rating of 26,001 or more pounds inclusive of a towed unit <br />
