accumulated compensatory time or if they have no accrued leave time, the driver <br /> will not be compensated for the hours of work missed. For a third offense, if shall <br /> be the City's policy that the employee shall be suspended without pay for one full <br /> day on referred for an evaluation by a certified substance abuse professional. <br /> (B) For an alcohol test result indicating an alcohol content of 0.04 or greater the <br /> employee will be suspended without pay for 24 hours after completion of the test. <br /> Removed from all safety-sensitive functions until they have been referred for an <br /> evaluation by a certified substance abuse professional. If that evaluation <br /> determined that the driver is chemically dependent, the employer will give the <br /> employee an opportunity to participate in, at the employees own expense or <br /> pursuant to coverage under the_driver-s benefit pian. <br /> 7. Controlled Substance and Alcohol . The driver must complete any recommended <br /> treatment assessed by Substance Abuse Professional. Take a return to duty test with a <br /> negative drug test result or an alcohol test result indicating an alcohol content of less than <br /> 0.02. The driver is subject to random-follow up testing for 60 months. Random follow- <br /> up testing will occur a minimum of 6 times in the first 12 months following return-to- <br /> duty and shall not exceed 60 months from the date of the employee's return to duty. <br /> If the employee refuses to participate in the counseling or rehabilitation program or fails <br /> to successfully complete the program as evidenced by withdrawal from the program <br /> before its completion; or is unable to perform the safety sensitive functions of the job in <br /> question because of a positive test result on any subsequent return-to-duty or follow-up <br /> testing after completion of the program or presents a direct threat to property or safety of <br /> others, or its otherwise considered unable to perform in good faith, the City may <br /> discharge the employee from employment. <br /> Nothing in this policy limits the right of the City to discipline or discharge a driver on <br /> other grounds, including but not limited to a conviction of any criminal drug statute for a <br /> violation occurring in the workplace. <br /> REFERRAL, EVALUATION, AND TREATMENT <br /> 1. Resource Advisory. Each driver who engages in conduct prohibited by federal law and <br /> this policy shall be advised by the City of the resources available to the driver in <br /> evaluating and resolving problems associated with the misuse of alcohol and use of <br /> controlled substances, including the names, addresses, and telephone numbers of <br /> substance abuse professionals and counseling treatment programs. <br /> 2. Evaluation by a Substance Abuse Professional. Each driver who engages in conduct <br /> prohibited by this policy shall be evaluated by a substance abuse professional who shall <br /> determine what assistance, if any, the driver needs in resolving problems associated with <br /> 17 <br />
