Current zoning of the property is R-1, Single Family Residential. This land use <br /> classification does not allow the type of large scale condominium development that <br /> was approved as part of the plat. However, based on the discussions between <br /> Staff and the Attorney, it could be claimed by Harstad that by approving the Plat <br /> the City performed a "defacto" rezoning of the property. <br /> Staff has a meeting scheduled with the City Attorney to discuss the issue further. <br /> Should any further information come to light as a result of this meeting, Staff will <br /> forward it to the City Council. <br /> Paul <br />
