tw/ AP1711 <br /> Mounds View City Council Page 4 <br /> Regular Meeting April 24, 1995 <br /> 1 Mike Ulrich, Director of Public Works, used a drawing board to <br /> 2 illustrate the position of the waterline break and specified the <br /> 3 procedures that took place to repair the break. <br /> 4 <br /> 5 Samantha Orduno, City Administrator, furnished the background of <br /> 6 the policy regarding the property owner's responsibility in <br /> 7 connection with waterline repairs. <br /> 8 <br /> 9 Duane McCarty, 8060 Long Lake Road, said that he thought the City <br /> 10 should be responsible and care for those things that the City <br /> 11 builds. He remarked that all of the structures that are located <br /> 12 within the right-of-way are impacted by a broad range of public <br /> 13 uses. Mr. McCarty asked a direct question: Does the Council feel <br /> 14 that individual home owners should be responsible for failures of <br /> 15 City property? <br /> 16 <br /> 17 Councilmember Trude proposed that Council review the Ordinance at <br /> 18 the next Work Session and at that time address the issue of <br /> 19 additional costs which would be incurred by the City if the <br /> 20 Ordinance is changed. <br /> 21 <br /> 22 Councilmember Hankner concurred with Councilmember Trude that the <br /> 23 Ordinance should be discussed at the upcoming Work Session along <br /> 24 with the City's liability in the event the Ordinance would be <br /> 25 changed. <br /> 26 <br /> 27 Mike Ulrich stated that not all water and sewer service is City <br /> 28 installed. He cited projects where private contractors were used <br /> 29 to install the services. <br /> 30 <br /> 31 Bruce Ritter, 5240 Greenfield Avenue, requested clarification of <br /> 32 the procedures used to repair the waterline break. An explanation <br /> 33 was offered by Mr. Ulrich. <br /> 34 <br /> 35 Mayor Linke advised that the Ordinance would be reviewed by Council <br /> 36 and no payment would be expected from Ms. Sandidge until a decision <br /> 37 had been reached regarding the Ordinance. <br /> 38 <br /> 39 PUBLIC HEARINGS: <br /> 40 <br /> 41 Consideration of Resolution No. 4760 Approving a Conditional Use <br /> 42 Permit to Allow an Oversized Garage for Anthony Honkomp, 2908 Ardan <br /> 43 Avenue <br /> 44 <br /> 45 Mayor Linke opened the public hearing at 8 : 00 p.m. <br /> 46 <br /> 47 Paul Harrington, Community Development Coordinator, reported that <br /> 48 Anthony Honkomp had applied for a Conditional Use Permit to allow <br /> 49 the construction of a 940 square foot attached garage to his <br /> 50 proposed single family home at 2908 Ardan Avenue.
