Subd. 4. "Director"means and refers to the director of parks --_• <br /> and recreation - that person authorized by the Mounds View City <br /> Council to direct the department of parks and recreation. <br /> Subd. 5. "Department"means and refers to the City of Mounds <br /> View Parks and Recreation Department. <br /> Subd. 6. "Open space waters" means any public shoreline <br /> owned by or under the authority of the City of Mounds View. <br /> Subd. 7. "Law enforcement officer" means and refers to any <br /> person duly deputized or commissioned by the City of Mounds View, <br /> • <br /> Board of Ramsey County Commissioners or the State of Minnesota for <br /> the purpose of enforcing the laws, ordinances and regulations of their <br /> respective jurisdictions. <br /> Subd. 8. "Motor vehicle" means every vehicle which is <br /> self-propelled and does not derive its power from overhead wires. <br /> Motor vehicles include, but shall not be limited to automobiles, trucks, <br /> motor bikes, mini bikes, all-terrain vehicles and snowmobiles - with the <br /> exception of battery powered wheelchairs. <br /> 908.03 CONSTRUCTION AND SCOPE. In the interpretation <br /> of this chapter, all provisions contained are to be construed as follows: <br /> Subd. 1. Any requirement or prohibition by any provision <br /> extends to and includes the causing, procuring, aiding or abetting <br /> directly or indirectly, of such acts; and the permitting or allowing any <br /> minor by the responsible parent, guardian, or custodian to commit any <br /> such act. <br /> Subd. 2. No provision shall make unlawful any act necessarily <br /> performed by any law enforcement officer or department employee in the <br /> line of duty or work as such, or by any person, his agents or <br /> employees, in the proper and necessary execution of the terms of any <br /> contract or agreement with the City of Mounds View. <br /> Subd, 3. Any act otherwise prohibited by statute or local <br /> ordinances, is lawful if performed under, by virtue of and strictly <br /> within the provisions of a department permit to do so, and to the extent <br /> authorized thereby. <br /> 908.04 HOURS AND ACCESS <br /> Subd. 1. The recreation and education opportunities of the <br /> system are available to all members of the public regardless of race, <br /> sex, age, creed, national origin or place of residency. <br /> Subd. 2. The park system shall be open to the public between <br /> the hours of 6:00 a.m. and 10:00 p.m., prevailing time in the City. No <br /> person shall remain, stop, use or be present within the confines of any <br /> open space site between the hours of 10:00 p.m. and 6:00 a.m. <br /> Exceptions may be made at the discretion of the director in the case of <br /> emergency or when use permits have been authorized or for other <br /> JJTe5110 <br /> X12125-13 <br /> 2 <br />
