REQUEST FOR COUNCIL CONSIDERATION Agenda Section: 10. <br /> 111706 <br /> STAFF REPORT Report Number: 94-1059WS <br /> G Report Date: 2-3-94 <br /> AGENDA SESSION DATE February 7, 1994 <br /> DISPOSITION <br /> Item Description: Discussion Regarding Fire Contract <br /> Administrator's Review/Recommendation: <br /> - No comments to supplement this report <br /> - Comments attached. <br /> Explanation/Summary (attach supplement sheets as necessary.) <br /> SUMMARY; <br /> The cities of Spring Lake Park, Mounds View and Blaine have completed the <br /> draft contract with the Fire Department which turns over the assets and <br /> buildings to the City of Blaine who, under the Joint Powers Agreement <br /> (Section III E) shall hold the property nominally with each of the cities <br /> having a percentage ownership based on the historical share of the capital <br /> costs. <br /> The basics of the contract call for a 10 year term with the cities owning <br /> all property and capital equipment. The Fire Department essentially becomes <br /> a department within the jurisdictional authority of all three of the <br /> cities. <br /> The contract has been in the drafting stages for the past three years with <br /> over 7 drafts and numerous meetings with the cities' and fire department <br /> representatives as well as general legal counsel. The contract is a sound <br /> one - one that will provide security both for the three cities and for a <br /> fire department that has had to relinquish a fair amount of control over <br /> their organization in exchange for an extended use contract. <br /> As I mentioned in the January 21st issue of This Is It, the City of Spring <br /> Lake Park has several issues regarding the contract. A copy of the concerns <br /> was provided by Don Busch and is attached. It is the SLP Council's <br /> intention not to approve the current draft of the contract.
