LEASE AGREEMENT <br /> This Lease is made, executed and delivered as of January 1, 1994, by and between <br /> CITY OF BLAINE, a Minnesota municipal corporation. with its principal office at 9150 <br /> Central Avenue N.E., Blaine, Minnesota 55434 (Landlord), and SPRING LAKE PARK <br /> FIRE DEPARTMENT, INC., a Minnesota corporation, with an address of 1710 Highway 10, <br /> Spring Lake Park, Minnesota 55435 (Tenant). <br /> ARTICLE I <br /> GRANT AND TERM <br /> Section 1.01. Premises. In consideration of rents, terms, covenants, and agreements <br /> to be performed and observed by Tenant, as hereinafter set forth, Landlord rents to Tenant, <br /> and Tenant rents from Landlord, six parcels of land (the Land) more specifically described <br /> on Exhibit A attached hereto and incorporated herein by reference,together with all rights <br /> and appurtenances belonging or appertaining thereto and all improvements now or hereafter <br /> located thereon (the Premises). The Premises includes all buildings, fixtures and other <br /> improvements constructed thereon (collectively, the Buildings) together with all fire fighting <br /> equipment and vehicles located thereon, including the personal property described on <br /> Exhibit B attached hereon and incorporated herein by reference (the Leased Equipment). <br /> Unless specified to the contrary, any reference herein to the Premises includes the Buildings <br /> and the Leased Equipment. <br /> Section 1.02. Term. Reference is made to the "Contract to Furnish Fire Protection <br /> Service to the Cities of Blaine, Mounds View and Spring Lake Park" dated as of January 1, <br /> 1994 (the Service Contract). The term of this Lease (the Term) shall be identical to the <br /> term of the Service Contact. If the Service Contract expires or terminates, this Lease shall <br /> expire or terminate on the same date. Any renewal or extension of the Service Contract shall <br /> also constitute an automatic renewal or extension, without further action or notice, of this <br /> Lease. The Commencement Date of this Lease is January 1, 1994. <br /> ARTICLE II <br /> USE AND OPERATION <br /> Tenant shall use and operate the Premises as fire station facilities and for no other <br /> purpose, except with the prior written consent of Landlord. <br /> spnnelease.agr-02110,"44 <br />
