DRAFT <br />4.16.2010 <br /> <br /> <br />Page 19 <br /> <br /> (c) is directed by a board of directors, executive committee, or other similar body <br />chosen by members at a meeting held for that purpose. No member, officer, agent, or <br />employee shall receive any profit from the distribution or sale of beverages to the <br />members of the club, or their guests, beyond a reasonable salary or wages fixed and <br />voted each year by the governing body. <br /> <br />Subd. 4. GAMBLING DEVICE: A contrivance the purpose of which is that for a <br />consideration a player is afforded an opportunity to obtain something of value, other than free <br />plays, automatically from the machine or otherwise, the award of which is determined <br />principally by chance, whether or not the contrivance is actually played. A gambling device <br />includes a video game of chance as defined by Minnesota Statutes Section 609.75, subdivision <br />8. <br /> <br />Subd. 4 5. INTOXICATING LIQUOR: Any ethyl alcohol distilled, fermented, spirituous, or <br />vinous or malt beverage containing more than three and two-tenths percent (3.2%) of <br />alcohol by weight. <br /> <br />Subd. 5. MINOR: Any person who has not reached the age of nineteen (19) as of their last <br />birthday. <br /> <br />Subd. 6. ORIGINAL PACKAGE: The corked bottle or sealed container in which the liquor <br />is placed by the manufacturer. <br /> <br />Subd. 7. PERSON: Includes a natural person of either sex, co-partnership, corporation and <br />or association of persons and the agent or manager of any of the aforesaid. The <br />singular number includes the plural, and the masculine pronoun includes the feminine <br />and neuter. <br /> <br />Subd. 8. RESTAURANT: A place of which the major business is preparing and serving <br />lunches or meals to the public to be consumed on the premises. (1988 Code §101.01) <br />An establishment, other than a hotel, under the control of a single proprietor or <br />manager, where meals are regularly prepared on the premises and served at tables to <br />the general public and having a minimum seating capacity for guests as prescribed by <br />this Code. <br /> <br /> <br />503.02: LICENSE REQUIRED: No person, except wholesalers and manufacturers to <br />the extent authorized by law13, shall deal in or dispose of by gift, sale or otherwise or keep or <br />offer for sale, any beer 3.2 percent malt liquor within the Municipality City without first <br />having received a license as hereinafter provided. (1988 Code §101.02) <br /> <br /> <br /> <br /> 1 M.S.A. §340.301 et seq.
