Item No: 7D <br />Meeting Date: November 22, 2010 <br />Type of Business: Council Business <br />Administrator Review: ____ <br /> <br />City of Mounds View Staff Report <br /> <br /> <br /> <br />To: Honorable Mayor and City Council <br />From: Nick DeBar, Public Works Director <br />Item Title/Subject: Resolution 7702, Denying SIP Appeals and Approving the <br />Proposed Locations of Stormwater Infiltration Basins in Area D of <br />the Street and Utility Improvement Program <br />Background: <br />The Stormwater Infiltration Program (SIP) is the City’s approach to meeting the stormwater <br />management rules and regulations when reconstructing streets associated the Street and <br />Utility Improvement Program (SUIP). The SIP is comprised of constructing stormwater <br />infiltration basins in the City-owned right-of-way. The City also established a process for <br />property owners to appeal the location of an adjacent infiltration basin proposed in front of <br />their property. A specific set of physical and hardship parameters must by met for the City to <br />consider the appeal. <br /> <br />Discussion: <br />The City has provided adjacent property owners the following opportunities to become aware <br />of the City’s intent to construct the infiltration basins in front of their property and to learn more <br />about the proposed basins: <br /> <br />Oct. 7, 2010: Notice sent to adjacent property owners (with SIP FAQ handout – see attached) <br />Oct. 18, 2010: Public information meeting for stormwater infiltration basins in Area D <br />Oct. 7 - Nov. 5, 2010: Appeal period and request to City for on-site marking of basin locations <br />Nov. 5 - 15, 2010: City staff reviews submitted SIP appeals <br />Nov. 15, 2010: Street & Utility Committee review submitted SIP appeals <br />Nov. 22, 2010: City Council considers SIP appeals <br /> <br />There are 52 proposed stormwater infiltration basins in Area D (see attached). City staff <br />received and marked five requests for on-site marking of individual basin locations during the <br />appeal period. The City received two SIP appeal forms for three infiltration basins planned in <br />Area D. The following is a discussion of each appeal (also attached). <br /> <br />5486 Erickson Road (Rendell Hansen) – SIP#49 <br />Mr. Hansen does not claim to have any sort of physical or hardship parameters to base his <br />appeal on. Rather, Mr. Hansen states he prefers not to have an infiltration basin located in <br />the City boulevard in front of his property. Furthermore, Mr. Hansen suggests that the City <br />check into the feasibility of moving the basin to the property just south of his (5494 Erickson), <br />believing that this may be a more suitable location. <br /> <br /> City staff and the S/U Committee (3-1) recommend denying this appeal since no specific <br />physical or hardship parameters exist. <br /> <br />5445 Jackson Drive (Levitan Limited Partnership/The Sands Apts.) – SIP#35 and #39 <br />This appeal is for The Sands Apartments and the appeal is claiming two physical parameters. <br />The first based upon item A4 (on the appeal form) relating to potential stormwater hot spot <br />land uses. This parameter indicates that the basins will be used in locations where runoff is <br />generated from land uses with produce higher levels of stormwater pollutants. The property
