<br />Item No: 07I <br />Meeting Date: December 13, 2010 <br />Type of Business: Council Business <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: James Ericson, City Administrator <br />Item Title/Subject: Resolution 7716, a Resolution Amending the City’s Personnel <br />Manual <br /> <br />Introduction: <br /> <br />The League of Minnesota Cities, as a result of an employment matter undergoing legal <br />review, suggests the Council add some disclaiming language to its Personnel Manual. In <br />addition, other revisions were deemed necessary to eliminate conflicting language between <br />sections and to eliminate an inconsistency between the Personnel Manual and the City <br />Code. <br /> <br />Discussion: <br /> <br />Revision #1. Recently, the League of MN Cities suggested that the City consider adding <br />“disclaimer language” to the Personnel Manual that would clarify that (1) the City Council <br />retains the right and discretion to modify the Personnel Manual; (2) the City Council retains <br />responsibility for any necessary interpretation; and that (3) nothing in the Manual should be <br />construed to be a contract. The specific language suggested is as follows: <br /> <br />Nothing in this Personnel Manual should be construed as a contract. <br />The City has the right to change these policies, procedures, and <br />benefits as it deems appropriate without notice. Responsibility for <br />final interpretation of any specific issues as they relate to policies, <br />procedures, and benefits lies with City Council. <br /> <br />The introductory statements in the Personnel Manual already acknowledge that the Council <br />has the right and ability to modify the stated polices, but the other provisions noted above <br />needed to be added. The revised paragraph reads as follows (with the additional language <br />underlined for reference.) <br /> <br />The City reserves the right, at its discretion, to change or terminate <br />any provision of this handbook or to add new provisions at any time <br />without prior notification. Responsibility for final interpretation of <br />any specific issues as they relate to policies, procedures, and benefits <br />lies with City Council. Suggestions you have for changes in the City's <br />personnel policies are welcome and should be submitted in writing to <br />the City Administrator. If, and whenever, information in this packet <br />conflicts with a union contract, the union contract shall override the <br />packet information. This Personnel Manual itself is not an <br />employment contract, and nothing herein should be construed as <br />such. <br /> <br />
