<br />Item 07I <br />December 13, 2010 <br />Page 3 <br /> <br />Assuming the Council prefers to retain control over this personnel function (since it <br />maintains control over hiring decisions), staff would recommend changing Section 1.05 to <br />replace the present language with the following passage: <br /> <br />The City Administrator, or the Department Head with the <br />concurrence of the City Administrator, may recommend termination <br />of an employee. Terminations shall be approved by the City Council. <br /> <br />Inconsequential revisions <br /> <br />While reviewing the Personnel Manual, staff observed many references, statutory and <br />otherwise, position titles, footnotes and other areas in need of revision. There are <br />references to policies which no longer exist or are no longer applicable or pertinent which <br />should be deleted, and there are “missing” references to policies that have been adopted <br />that need to be added. Also, there are a few poorly written and unclear passages, <br />typographical errors, redundant paragraphs and other notations which simply need to be <br />updated. These types of changes will be made administratively during the revision <br />process. <br /> <br />Additional Revisions May Be Required <br /> <br />It is quite likely that staff will identify other policies that will necessitate revision approved by <br />the City Council, such as the policy dealing with Offensive Behavior and Sexual <br />Harassment, which has been forwarded to the attorney for his review. We hope to <br />conclude our review of the Personnel Manual within the next month. <br /> <br />Recommendation: <br /> <br />The Personnel Manual is presently in need of three revisions. The first is recommended by <br />the League of MN Cities which would add “disclaiming” language to the introductory <br />passages of the manual. The second would eliminate the inconsistency between Sections <br />1.05 and 1.37 regarding probationary employees. The third revision requiring Council <br />approval clarifies that the City Council, not the City Administrator, approves employee <br />terminations.
