Mounds View City Council November 22, 2010 <br />Regular Meeting Page 2 <br /> <br />Hearing no public input, Mayor Flaherty closed the public hearing at 7:20 p.m. 1 <br /> 2 <br />Council Member Mueller asked for further information on operational fire permits. Community 3 <br />Development Director Roberts explained these permits allowed for the operation of a fire alarm 4 <br />system. 5 <br /> 6 <br />Council Member Mueller questioned if the residential fire suppression system inspection fee was 7 <br />going to be waived. City Administrator Ericson stated this was discussed and he would review 8 <br />the matter further. 9 <br /> 10 <br />Council Member Mueller asked if the variance fees were set to cover staff and attorney expenses. 11 <br />City Administrator Ericson stated staff expenses were covered. Anything over and above, 12 <br />whether engineering or attorney fees would be paid separately. He indicated not all variance 13 <br />requests are brought to the attorney for review. 14 <br /> 15 <br />Council Member Mueller requested that language be added to the document to explain that 16 <br />additional engineering and attorneys fees would be at the applicant’s expense. City 17 <br />Administrator Ericson reviewed a disclaimer that covered this information adding that this same 18 <br />language was included in the variance permit paperwork. 19 <br /> 20 <br />Council Member Mueller explained the Council had discussed change to the tobacco offense 21 <br />fines. City Administrator Ericson indicated he would make the recommended changes. 22 <br /> 23 <br />Council Member Mueller requested additional information on the Water Tower Communication 24 <br />Fees. Public Works Director DeBar indicated one was a water tower access fee, and the other 25 <br />was for an annual registration of vendors. 26 <br /> 27 <br />Mayor Flaherty asked if the sales to minor’s fees, on Page 15, were going to be increased. City 28 <br />Administrator Ericson indicated the City fees were on top of the State fines and was a 29 <br />misdemeanor. He explained the Council did discuss this issue in detail but no decision was 30 <br />made. City Attorney Riggs indicated a fine of over $1,000 would make the offense a gross 31 <br />misdemeanor. 32 <br /> 33 <br />MOTION/SECOND: Mueller/Hull. To Waive the Reading and Adopt Resolution 7700, 34 <br />Approving the 2011 Fee Schedule. 35 <br /> 36 <br /> Ayes – 5 Nays – 0 Motion carried. 37 <br /> 38 <br />B. Introduction and First Reading of Ordinance 855, an Ordinance Amending 39 <br />Appendix E of the Municipal Code about Planning Development Fees. 40 <br /> 41 <br />Community Development Director Roberts reviewed an Ordinance amending Appendix E of the 42 <br />Municipal Code regarding Planning and Development Fees. He indicated State Statute requires 43 <br />that these fees be amended through an Ordinance amendment. Staff recommends approval of the 44 <br />first reading of Ordinance 855. 45
