It is recommended that an Agreement be developed for use between the City and the private property owner for each such improvement, to state in writing the roles and responsibilities of each party. The Agreement could contain standard language and terms, and provide blanks to be completed for each specific application: -Property information -Improvement to be performed -Cost / fee for the work -Method of payment -Signatures For the case of driveway improvements, forms would be included in the Agreement to clarify the work as well as to state requirements for any matching improvements the property owner must perform on their property. During the discussion at the February 2, 2009 Work Session, Council appeared to concur with this proposed approach. Through the course of discussion, our understanding of the Council opinion on several parameters for the policy is as follows: x Agreement required Council and Staff concurred that a signed Agreement between the property owner and City should be required for the improvements. x Financing of the Improvements Resolution 7338 sets this parameter for Non-Conforming Driveways. It states that the property owner will be responsible for 100% of the cost. Council and Staff concurred that this same requirement should be applied to all private improvements performed. Council and Staff concurred that options should be included in the program for immediate payment of the work in full or for financing the improvements over a period of time. Staff was to develop detailed recommendations for the payment procedures. x Setting of Fees The City Council indicated their preference that the costs for the work be based on the construction contract for each project area.
