February 23, 2009 Item No. 7C <br />Page 4 <br />x Driveway widening within City Code requirements <br />Discussion was held on the specific situation of a property owner with <br />a conforming driveway who wished to widen their driveway, within the <br />maximum width allowed by the City Code. The private improvement <br />that would be provided under the public City contract would only be for <br />the curb cut and the 5-foot deep concrete apron for this “extra width”. <br />Completion of the rest of the driveway for this “extra width” portion <br />would be the responsibility of the property owner. <br />Staff and Council concurred that a time limit should be set by which the <br />property owner should be required to complete the remainder of the <br />driveway. Council stated their opinion that the time limit should be one <br />year. If the property owner does not complete the remainder of the <br />driveway within the time limit, the intent is that the City would have the <br />right to remove the “extra width” of the driveway apron, reducing it <br />back down to the width of the existing driveway. The cost of this <br />removal would also be the responsibility of the property owner. <br />x Work within public right-of-way only <br />It was discussed that for non-conforming driveways approved for this <br />program, as well as for new sanitary sewer and water services, the <br />work would not extend beyond the public right-of-way line. Due to <br />liability, permission, and other reasons, it is not recommended that the <br />City contractor perform work under the City contract on private <br />property. <br />Although not expressly discussed during the Work Session, it must be <br />noted that Staff recommendation is that this condition be applied to <br />replacement of existing sanitary sewer services as well. The work <br />included under the City contract should be limited to that portion within <br />the public right-of-way only. If a property owner wishes to have the <br />segment of their sanitary sewer service from the right-of-way line to <br />their home replaced, they would need to have that work performed <br />under a private contract. The property owner could hire the City <br />contractor to do the work, however the policy should be set such that <br />the portion of the work on the private property be a private contract <br />between the property owner and the contractor. <br />Policy Documents <br />Resolution 7415 has been prepared in accordance with the previous discussion. <br />The Resolution would be intended to adopt the parameters for application of this <br />program for all projects within the overall Street and Utility Improvement <br />Program.
