April 27, 2009 Item No. 7D <br />Page 2 <br />Discussion: <br />LSWMP Approval Process <br />Upon receiving review comments from the RCWD and the Metropolitan Council, <br />Bonestroo prepared a final version of the LSWMP (dated April 2009) and a <br />response letter to address the RCWD comments. The response letter included <br />the pages from the LSWMP that were revised to address the comments. A total <br />of eight pages were revised, and also the overall stormwater system map. A <br />copy of the response letter, the revised LSWMP pages, and revised map are <br />attached to this Staff Report for reference. <br />For the sake of convenience, only those revised pages and the revised map from <br />the LSWMP are provided with this Staff Report. Should Council wish to review <br />any other portion or the entire LSWMP, they are referred to their copy of the <br />Agency Review Draft, from the City Council work session of February 2, 2009. <br />Pursuant to Minnesota Statute 103B.235, Mounds View’s LSWMP dated April <br />2009 was reviewed and approved by the Rice Creek Watershed District on April <br />22, 2009. The approval letter from the RCWD and the RCWD Board of Managers <br />Resolution 2009-16 approving the LSWMP dated April 2009 are attached to this <br />Staff Report for reference. <br />According to Minnesota Statute 103B.235, Mounds View shall adopt the <br />approved LSWMP within 120 days of approval by the RCWD. The LSWMP is <br />adopted via resolution. Resolution 7447 has been prepared for this purpose, and <br />is included with this Staff Report. <br />Once the LSWMP is adopted by the City, a copy will be forwarded to the RCWD <br />for their file. A copy of the adopted LSWMP must also be forwarded to <br />Metropolitan Council, along with the dates of RCWD approval and City adoption <br />of the LSWMP. Copies of Resolution 2009-16 from RCWD and Resolution 7447 <br />from the City will be provided to the Metropolitan Council as proof of the dates. <br />MS4 Mapping Components <br />The MS4 permit is administered by the Minnesota Pollution Control Agency, and <br />is not under the jurisdiction of RCWD. Therefore, only those revisions to the <br />Stormwater System Map necessary to address the RCWD comments were <br />completed for submittal and approval at the RCWD April 22, 2009 Board <br />meeting. Therefore, the copy of the Stormwater System Map included with this <br />Staff Report, which is the version that was provided to RCWD, is not the final <br />version that includes the MS4 information. <br />However, as authorized by the City Council under Resolution 7439, Bonestroo <br />has updated the Stormwater System Map in the LSWMP to include the required <br />information in accordance with the MS4 permit. The combined map is going <br />through final review by City Staff now, and is anticipated to be printed in its final <br />form on April 27, 2009.
