<br /> <br />LAKESIDE LIONS PARK JOINT POWERS AGREEMENT <br /> <br /> <br /> This Joint Powers Agreement (“Agreement”) dated this 23rd day of November, 2009, is entered <br />into by and between the City of Mounds View, a Minnesota municipal corporation (Mounds View) and the <br />City of Spring Lake Park, a Minnesota municipal corporation (Spring Lake Park). This Agreement is <br />made pursuant to the authority conferred upon the parties by Minnesota Statutes Section 471.59. <br /> <br />RECITALS <br /> <br /> WHEREAS, the property currently known as Lakeside Lions Park was deeded to the Cities of <br />Mounds View and Spring Lake Park by Park Playground Inc., a Minnesota corporation, in 1959 and the <br />deed contained language requiring the property to revert back to Park Playground Inc. in the event the <br />City Councils determined to use this land for something other than park land; and, <br /> <br /> WHERAS, at that time the City Councils agreed to jointly operate said park for playground and <br />recreational purposes and created the Lakeside Park Commission, comprised of representation from both <br />cities, charged with the responsibility of providing a well-balanced recreational program and granted <br />whatever general and specific powers necessary to provide said program; and, <br /> <br /> WHEREAS, both cities adopted resolutions in 1981 that memorialized that agreement; and, <br /> <br /> WHEREAS, the Lakeside Park Commission was dissolved later in 1981 and the cities continued <br />to jointly operate the park, but no new agreement was ever entered into; and, <br /> <br /> WHEREAS, in July, 1983, the cities received a quit claim deed from Park Playground, Inc. <br />conveying the park land to the Cities of Mounds View and Spring Lake Park, in joint ownership, for park <br />and playground purposes only; and, <br /> <br /> WHEREAS, the property is legally described on attached Exhibit A; and, <br /> <br /> WHEREAS, an aerial photo of the Park is attached as Exhibit B; and, <br /> <br /> WHEREAS, at this time, the cities would like to enter into a formal joint powers agreement <br />concerning the joint operation of the park and agree as follows: <br /> <br /> <br />SECTION I <br />RESPONSIBIITIES OF THE PARTIES <br /> <br />1.01. Spring Lake Park’s Responsibilities. With respect to the Park administration, maintenance <br />and operation, Spring Lake Park’s responsibilities will include, but not limited to, the following at no cost to <br />the City of Mounds View: <br /> <br />A. Inspect all fences, signs and amenities and perform routine repairs. <br />B. Treat Spring Lake with chemicals as needed for the control of swimmer’s itch and weed <br />control. <br />C. Start up and drain the water system each year. <br />D. Water the grass and landscaping. <br />E. Pick up trash and empty trash receptacles on a regular basis. <br />F. Mow, fertilize, seed and maintain the grass for weed control. <br />G. Scarify the softball infields and replace ag lime as needed. <br />H. Trim and water trees as needed. <br />I. Wash down the beach house and clean and scrub bathrooms and floors weekly.
