Item No: 7C <br />Meeting Date: January 14, 2008 <br />Type of Business: Public Hearing <br />Administrator review: ________ <br /> <br />City of Mounds View Staff Report <br /> <br />To: Honorable Mayor and City Council <br />From: Heidi Heller, Planning Associate <br /> Item Title/Subject: Consideration of a Conditional Use Permit for the Storage of <br />Flammable Liquids at 4815 Mustang Circle; Planning Case <br />No. CU2006-009 <br /> <br />Introduction: <br /> <br />The applicant, Tyson Company, withdrew this application on Monday, January 7, 2008. <br />Since this case has already been before the Planning Commission and a public hearing had <br />been scheduled and published for the January 14th Council meeting, the City Attorney <br />recommends that the Council hold the public hearing as scheduled and take action with a <br />resolution of denial to close the case. <br /> <br />This planning case first came before the Planning Commission in October 2006. The <br />Planning Commission tabled the case and requested that a risk management plan be <br />submitted to the City by Ferrellgas. Propane regulations fall under the fire code, so the City <br />opted to hire Rich Pehrson with Futrell Fire Consult & Design to review this risk management <br />plan and to assist city staff with safety requirements and precautions that should be taken if <br />this proposal were to move forward. On December 5, 2007, the Planning Commission heard <br />many concerns and opposition from neighboring businesses and Townsedge Terrace <br />Manufactured Home Park, along with safety concerns from City Staff due to the close <br />proximity of the propane tanks to hundreds of nearby employees and the residents of <br />Townsedge Terrace. Another important concern was the response time to this particular <br />location by the fire department. This industrial park is the furthest area of Mounds View from <br />the SMB Fire Department, Station 1. Ultimately, the Planning Commission voted 7-0 to <br />recommend denial of this conditional use permit. <br /> <br />Summary of Conditional Use Permit Planning Case: <br /> <br />The Tyson Company owns four lots on Mustang Circle which are zoned industrial and total <br />about 20 acres. They had requested approval of a conditional use permit to allow for the <br />storage of flammable liquids on their property located at 4825 Mustang Circle. Tyson was <br />working with Ferrellgas in New Brighton to relocate their business onto about 1 ½ acres at <br />the southernmost part of their property. Currently Ferrellgas is located at 1430 Old Highway <br />8, New Brighton, in the northwest quadrant area that is being redeveloped, and the city is <br />buying their property. Tyson Company currently has a Conditional Use Permit in order to <br />allow for a motor freight terminal. An amendment to the current Conditional Use Permit <br />would be required in order to allow for the storage of flammable liquids in an industrial zoned <br />district. <br /> <br />Ferrellgas proposed to have three main above ground propane tanks (30,000 gallons each) <br />and would construct two smaller buildings, approximately 1,500 square feet and 1,800 <br />square feet, for office space, storage, and a dock for filling portable cylinders.
