Staff recommends authorization for the City’s legal counsel to create a Joint <br />Powers Agreement with the City of Spring Lake Park for the 2008 Street <br />Maintenance Project. This should be a fairly simple matter for the City’s legal <br />counsel, given that to create this document, only minor modifications to the 2007 <br />agreement would need to be made. <br /> <br /> <br />Set Public Improvement Hearing – As per State Statute 429.031: “Before the <br />municipality awards a contract for an improvement or orders it made by day <br />labor, or before the municipality may assess any portion of the cost of an <br />improvement to be made under a cooperative agreement with the state or <br />another political subdivision for sharing the cost of making the improvement, the <br />council shall hold a public hearing on the proposed improvement following two <br />publications in the newspaper of a notice stating the time and place of the <br />hearing, the general nature of the improvement, the estimated cost, and the area <br />proposed to be assessed.” <br /> <br />Staff is recommending that a public hearing be conducted to be in compliance <br />with this state statute and to allow the public to learn about the proposed project <br />and provide comments. <br /> <br />A hearing date of March 10, 2008 will afford the necessary time to publish legal <br />notices. It is also anticipated that the final Feasibility Report will be presented to <br />the City Council on March 10, 2008 for consideration of approval. <br /> <br />Following the hearing, should the City Council wish to proceed with this project, a <br />Staff report and resolution approving the report, ordering the project, and <br />authorizing the creation of detailed plans and specifications will be presented for <br />City Council consideration. <br /> <br /> <br />Should this project proceed, the following is the tentative schedule: <br /> <br />February 11, 2008 Public Improvement Hearing Date Set for March 10, 2008 <br /> <br />March 10, 2008 Public Improvement Hearing is held, City Council <br />approves Feasibility Report, orders the project, <br />authorizes the preparation of Plans and <br />Specifications, and approves Joint Powers Agreement <br />with Spring Lake Park <br /> <br />May 12, 2008 City Council Approves Plans and Specifications, sets <br />a June 12, 2008 bid date, and authorizes the <br />advertisement for bids <br /> <br /> <br />June 12, 2008 Bids Received (Thursday 10:00 AM, Mounds View <br />City Hall)
