Staff further recommends that the 2009-2010 Street and Utility Improvement
Project be developed based on the various specific design aspects for 2007-
2008 Street and Utility Improvement Project that were previously agreed to by
the City Council. These include:
Elimination of the access of Hillview Road and Fairchild Avenue
Hillview Park Parking Improvements –providing a parking area

There are two roads within the 2009-2010 Street and Utility Improvement Project
area that are designated pedestrian corridors as per the City’s comprehensive
trailway plan. These are: Red Oak Drive and Hillview Road. As per the Street
and Utility Improvement Program, the City will conduct public meetings to obtain
input on these two roadways. The City will be developing a raingarden program
this year. Once completed, the City will then conduct public meetings to discuss
the installation of raingardens as part of this project.

Schedule – A typical schedule for nine projects planned as part of the overall
Street and Utility Improvement Program as been developed (see attachment). A
detailed project schedule for the 2009-2010 Street and Utility Improvement
Project will be developed and presented at a public hearing.

Set Public Improvement Hearing – As per State Statute 429.031: “Before the
municipality awards a contract for an improvement or orders it made by day
labor, or before the municipality may assess any portion of the cost of an
improvement to be made under a cooperative agreement with the state or
another political subdivision for sharing the cost of making the improvement, the
council shall hold a public hearing on the proposed improvement following two
publications in the newspaper of a notice stating the time and place of the
hearing, the general nature of the improvement, the estimated cost, and the area
proposed to be assessed.”

Although not required as per current City Charter language, Staff is
recommending that a public hearing be conducted to be in compliance with state
statute and to allow the public to learn about the proposed project and to provide
comments.

A hearing date of March 24, 2008 will afford the necessary time to publish legal
notices.

Recommendation:
It is recommended the City Council approve a resolution setting a Public
Improvement Hearing date for the 2009-2010 Street and Utility Improvement
Project.

Respectfully Submitted,

Greg Lee, Director of Public Works
