Staff further recommends that the 2009-2010 Street and Utility Improvement <br />Project be developed based on the various specific design aspects for 2007- <br />2008 Street and Utility Improvement Project that were previously agreed to by <br />the City Council. These include: <br />Elimination of the access of Hillview Road and Fairchild Avenue <br />Hillview Park Parking Improvements –providing a parking area <br /> <br />There are two roads within the 2009-2010 Street and Utility Improvement Project <br />area that are designated pedestrian corridors as per the City’s comprehensive <br />trailway plan. These are: Red Oak Drive and Hillview Road. As per the Street <br />and Utility Improvement Program, the City will conduct public meetings to obtain <br />input on these two roadways. The City will be developing a raingarden program <br />this year. Once completed, the City will then conduct public meetings to discuss <br />the installation of raingardens as part of this project. <br /> <br />Schedule – A typical schedule for nine projects planned as part of the overall <br />Street and Utility Improvement Program as been developed (see attachment). A <br />detailed project schedule for the 2009-2010 Street and Utility Improvement <br />Project will be developed and presented at a public hearing. <br /> <br />Set Public Improvement Hearing – As per State Statute 429.031: “Before the <br />municipality awards a contract for an improvement or orders it made by day <br />labor, or before the municipality may assess any portion of the cost of an <br />improvement to be made under a cooperative agreement with the state or <br />another political subdivision for sharing the cost of making the improvement, the <br />council shall hold a public hearing on the proposed improvement following two <br />publications in the newspaper of a notice stating the time and place of the <br />hearing, the general nature of the improvement, the estimated cost, and the area <br />proposed to be assessed.” <br /> <br />Although not required as per current City Charter language, Staff is <br />recommending that a public hearing be conducted to be in compliance with state <br />statute and to allow the public to learn about the proposed project and to provide <br />comments. <br /> <br />A hearing date of March 24, 2008 will afford the necessary time to publish legal <br />notices. <br /> <br />Recommendation: <br />It is recommended the City Council approve a resolution setting a Public <br />Improvement Hearing date for the 2009-2010 Street and Utility Improvement <br />Project. <br /> <br />Respectfully Submitted, <br /> <br /> <br />Greg Lee, Director of Public Works <br />
