<br />Item No:7B <br />Meeting Date: April 28, 2008 <br />Type of Business: CB <br />Administrator Review: _____ <br />City of Mounds View Staff Report <br /> <br />To: Honorable Mayor and City Council <br /> <br />From: Jeremiah Anderson, Housing/Code Enforcement Inspector <br /> <br />Item Title/Subject: Resolution 7262 Authorizing Abatement of Nuisance Code <br />violations outside 2318 Knoll Drive <br /> <br />Date of Report: April 24, 2008 <br /> <br /> <br /> <br />Background: <br />On March 11, 2008, staff inspected the property located at 2318 Knoll Drive and observed <br />a large flatbed type 5th wheel trailer in the driveway loaded with inoperable equipment, <br />automotive parts and engines, household appliances, and rusting metal. This single <br />family residential home is adjacent to the walking path located between Hillview Road and <br />Knoll drive. Staff issued a summary abatement order to the property owner Mr. Clifford <br />Wies Jr. citing an accumulation of junk, rusting metal, and old machinery outside in <br />violation of the City Nuisance Code and required corrective actions were completed no <br />later than March 21, 2008. Staff learned that Mr. Wies was away from home on vacation <br />and an extension was granted, to date the property remains in violation of the City <br />Nuisance Code. <br /> <br />Discussion: <br />Chapter 607 of the City Code defines and regulates nuisances. Section 607.02 defines <br />nuisances in their most general form as any act, substance, matter, emission or thing which <br />creates a dangerous or unhealthy condition or which threatens the public peace, health, safety <br />or sanitary condition of the City or which is offensive or has a blighting influence on the <br />community. Section 607.03 Subdivision 3c applies specifically to public nuisances affecting <br />peace and safety. Section 607.03 Subdivision 3c prohibits The outside piling, storing or keeping <br />of old machinery, junk, furniture, household furnishings or appliances or component parts <br />thereof, rusting metal inoperable/unusable equipment, or other debris visible on private or public <br />property. <br /> <br />A review of City records indicates that the property at 2318 Knoll drive was issued a notice of <br />violation on September 18, 2003 regarding an accumulation of junk outside and a vehicle parked <br />off an improved driveway. A second notice of violation was issued on May 24, 2004 regarding <br />vehicles parked off the improved driveway and accumulations of junk and debris outside. Each <br />of these notices cited violations of the Chapter 607 of the City Code regarding exterior storage <br />and parking vehicles off an improved surface. <br /> <br /> <br /> <br /> <br />
