<br />In August of 2006 the matter of abatement regarding nuisance code violations at 2318 Knoll was <br />before the City Council for consideration. At that time Mr. Wies completed corrective actions <br />after the council meeting and staff did not perform an abatement. Again, in September of 2007 <br />Mr. Clifford Wies Jr. was issued a notice of violation for similar violations at 2318 Knoll Drive and <br />again Mr. Wies completed necessary corrective actions to satisfy ordinance requirements. <br /> <br />Section 607.09 Subdivision 5 of the Nuisance Code provides the City the opportunity to reach <br />compliance by abating (correcting) items in violation of the requirements contained within <br />Chapter 607. In non emergency cases where no immediate threat to the public health and safety <br />exists the City code requires that staff obtain City Council authorization prior to abatement of <br />violations and notify the property owner of their opportunity to be heard before the council, <br />provided however, that at least 10 days notice is provided.
