<br />Item No:7C <br />Meeting Date: April 28, 2008 <br />Type of Business: CB <br />Administrator Review: _____ <br />City of Mounds View Staff Report <br /> <br />To: Honorable Mayor and City Council <br /> <br />From: Jeremiah Anderson, Housing/Code Enforcement Inspector <br /> <br />Item Title/Subject: Resolution 7263 Authorizing Abatement of Nuisance Code <br />violations outside 8425 Spring Lake Rd <br /> <br />Date of Report: April 24, 2008 <br /> <br /> <br /> <br />Background: <br />On July 3, 2007, staff inspected the property located at 8425 Spring Lake Road in <br />response to information received regarding a large accumulation of inoperable vehicles <br />and automotive parts stored outside the property. Staff observed at least ten inoperable <br />snowmobiles and two inoperable motorcycles outside in the yard and several inoperable <br />automobiles. A notice of violation dated July 3, 2007 was issued to the property owner <br />Brady Newman. <br /> <br />On October 11, 2007 and again December 4, 2007 staff issued Ramsey County Court <br />Citations for continued violation of Section 607.07 Subdivision 2 of the Nuisance Code. <br />Mr. Newman failed to appear in Ramsey County District court on March 25, 2008 and a <br />bench warrant was issued. <br /> <br />Discussion: <br />Chapter 607 of the City Code defines and regulates nuisances. Section 607.02 defines <br />nuisances in their most general form as any act, substance, matter, emission or thing which <br />creates a dangerous or unhealthy condition or which threatens the public peace, health, safety <br />or sanitary condition of the City or which is offensive or has a blighting influence on the <br />community. Section 607.06 Subdivision 2 regulates the outside parking and storage of vehicles <br />requires that vehicles parked or stored outdoors are parked on an improved surface such as <br />asphalt, concrete, brick, or gravel parking areas. Section 607.07 Subdivision 2 prohibits the <br />outside parking and storage of abandoned, junk, and unsafe vehicles. To summarize these <br />requirements, vehicles parked or stored outdoors shall display current license and shall be fully <br />operational and in compliance with all vehicle safety regulations so as to be street legal. <br /> <br />A review of City records indicates that Mr. Newman applied for and was granted a <br />Conditional Use Permit to construct an oversized garage at this property in 1994. In the <br />planning application dated August 1, 1994 Mr. Newman requests “to add on additional <br />garage to other for collector car storage” [sic]. This increased the total garage size to 24’ <br />x 48’. <br /> <br /> <br /> <br />
