Mr. Newman’s request for a Conditional Use Permit to construct an oversized garage not <br />exceeding 1,264 square feet was approved by the Mounds View City Council on <br />September 26, 1994. Mr. Newman obtained a building permit October 11, 1994 and <br />began construction shortly thereafter. City records reveal a history of exterior parking and <br />storage of vehicles and equipment in violation of City Code requirements dated back to <br />1998. More recently, in July of 2006 a notice of violation was issued to Brady Newman <br />regarding inoperable vehicles parked outside 8425 Spring Lake Road and an <br />Administrative Offense was issued on August 8, 2006 for continued violations. <br /> <br />Section 607.09 Subdivision 5 of the Nuisance Code provides the City the opportunity to reach <br />compliance by abating (correcting) items in violation of the requirements contained within <br />Chapter 607. In non emergency cases where no immediate threat to the public health and <br />safety exists the City code requires that staff obtain City Council authorization prior to <br />abatement of violations and notify the property owner of their opportunity to be heard before <br />the council, provided however, that at least 10 days notice is provided.
