Mr. Newman’s request for a Conditional Use Permit to construct an oversized garage not
exceeding 1,264 square feet was approved by the Mounds View City Council on
September 26, 1994. Mr. Newman obtained a building permit October 11, 1994 and
began construction shortly thereafter. City records reveal a history of exterior parking and
storage of vehicles and equipment in violation of City Code requirements dated back to
1998. More recently, in July of 2006 a notice of violation was issued to Brady Newman
regarding inoperable vehicles parked outside 8425 Spring Lake Road and an
Administrative Offense was issued on August 8, 2006 for continued violations.

Section 607.09 Subdivision 5 of the Nuisance Code provides the City the opportunity to reach
compliance by abating (correcting) items in violation of the requirements contained within
Chapter 607. In non emergency cases where no immediate threat to the public health and
safety exists the City code requires that staff obtain City Council authorization prior to
abatement of violations and notify the property owner of their opportunity to be heard before
the council, provided however, that at least 10 days notice is provided. Staff has satisfied these
and other applicable requirements of Chapter 607 of the City Code.

Recommendations:

Staff recommends approval of Resolution 7263 authorizing abatement of remaining
Nuisance Code violations present outside 8425 Spring Lake Road within 5 days.

Respectfully submitted,

Jeremiah Anderson
Housing/Code Enforcement Inspector

Attachments
