Mounds View City Council April 14, 2008 Regular Meeting Page 2 1 Planner Heller explained the requested interim use permit for a temporary tent at Moe’s 2 Restaurant. In 2006 a deck was built and last year they started using a tent out on that deck. 3 Staff had asked them to obtain an interim use permit to allow them to use the tent for up to 180 4 days in a calendar year. With an interim use permit there are a few special requirements as part 5 of the approval process. Every time the tent goes up they will need to apply for fire permits and 6 the fire marshal will review and inspect with each permit. 7 8 Planner Heller noted that parking was reviewed when the deck was constructed and, since the 9 tent will only be used on the deck, Staff feels parking is adequate. 10 11 Planner Heller indicated that the tent size is limited to 5,000 square feet or 10% of building 12 square footage. Planner Heller noted that this interim use permit can be reviewed by the City at 13 any time if there are any issues with the use of the tent at the site. Planner Heller indicated that 14 all City Code requirements are satisfied with this interim use permit request, and Staff 15 recommends approval and the Planning Commission unanimously recommended approval. 16 17 Hearing no public comment, Mayor Marty closed the public hearing at 7:11 p.m. 18 19 Council Member Mueller thanked Staff for the well written report and noted that she is pleased 20 that there have been no issues with Moe’s previously. 21 22 MOTION/SECOND: Mueller/Hull. To Waive the Reading and Approve Resolution 7254, A 23 Resolution Authorizing An Interim Use Permit for a Temporary Tent at Moe’s Restaurant, 2400 24 County Highway 10. 25 26 Council Member Mueller asked whether Moe’s would ever consider expanding the deck area 27 into more restaurant space. Mike Glazee, Manager at Moe’s, indicated they do not want to take 28 the deck out of service, but have thought about that if the business continues to grow. 29 30 Mayor Marty said that usually the Resolution from the Planning Commission comes to Council 31 identical but Number 2 is different, in that the Council Resolution does not list that the tent is 32 only to be located on the deck. 33 34 MOTION/SECOND: Marty/Mueller. To Amend the Resolution to Add in Number 2 that this 35 IUP is valid only to be located on the deck. 36 37 Ayes – 5 Nays – 0 Amendment carried. 38 39 Ayes – 5 Nays – 0 Motion as Amended, carried. 40 41 B.
