Mounds View City Council April 14, 2008 <br />Regular Meeting Page 2 <br /> <br /> 1 <br />Planner Heller explained the requested interim use permit for a temporary tent at Moe’s 2 <br />Restaurant. In 2006 a deck was built and last year they started using a tent out on that deck. 3 <br />Staff had asked them to obtain an interim use permit to allow them to use the tent for up to 180 4 <br />days in a calendar year. With an interim use permit there are a few special requirements as part 5 <br />of the approval process. Every time the tent goes up they will need to apply for fire permits and 6 <br />the fire marshal will review and inspect with each permit. 7 <br /> 8 <br />Planner Heller noted that parking was reviewed when the deck was constructed and, since the 9 <br />tent will only be used on the deck, Staff feels parking is adequate. 10 <br /> 11 <br />Planner Heller indicated that the tent size is limited to 5,000 square feet or 10% of building 12 <br />square footage. Planner Heller noted that this interim use permit can be reviewed by the City at 13 <br />any time if there are any issues with the use of the tent at the site. Planner Heller indicated that 14 <br />all City Code requirements are satisfied with this interim use permit request, and Staff 15 <br />recommends approval and the Planning Commission unanimously recommended approval. 16 <br /> 17 <br />Hearing no public comment, Mayor Marty closed the public hearing at 7:11 p.m. 18 <br /> 19 <br />Council Member Mueller thanked Staff for the well written report and noted that she is pleased 20 <br />that there have been no issues with Moe’s previously. 21 <br /> 22 <br />MOTION/SECOND: Mueller/Hull. To Waive the Reading and Approve Resolution 7254, A 23 <br />Resolution Authorizing An Interim Use Permit for a Temporary Tent at Moe’s Restaurant, 2400 24 <br />County Highway 10. 25 <br /> 26 <br />Council Member Mueller asked whether Moe’s would ever consider expanding the deck area 27 <br />into more restaurant space. Mike Glazee, Manager at Moe’s, indicated they do not want to take 28 <br />the deck out of service, but have thought about that if the business continues to grow. 29 <br /> 30 <br />Mayor Marty said that usually the Resolution from the Planning Commission comes to Council 31 <br />identical but Number 2 is different, in that the Council Resolution does not list that the tent is 32 <br />only to be located on the deck. 33 <br /> 34 <br />MOTION/SECOND: Marty/Mueller. To Amend the Resolution to Add in Number 2 that this 35 <br />IUP is valid only to be located on the deck. 36 <br /> 37 <br /> Ayes – 5 Nays – 0 Amendment carried. 38 <br /> 39 <br /> Ayes – 5 Nays – 0 Motion as Amended, carried. 40 <br /> 41 <br />B. Resolution 7258 Consider an On-Sale Intoxicating Liquor License and 42 <br />Restaurant License located at 2400 County Road H2 for Kevin Halverson 43 <br />and David Tulgren (d.b.a.
