He then said that they have paid taxes on the property. 2 3 Council Member Flaherty indicated that the fees need to be paid. He then said that he has no 4 problem with a six month delay, but that would be it. 5 6 Planner Heller indicated that the only thing that could change would be if this property were to 7 sell, and then the approval process would start all over again. 8 9 Clerk-Administrator Ericson indicated that Staff’s concern is that this was applied for in 2006, 10 reviewed by the Planning Commission, and Council in 2006 and this is far too long to have this 11 outstanding. He then recommended a definitive action be taken at this time and move forward 12 with the denial. 13 14 Council Member Mueller asked if this is the same type of situation on the townhome 15 development in another area without an expiration date. Council member Mueller said she 16 thought it would be better to let the rezoning/plat expire and have the owner or developer come 17 back before the City when they were ready to move forward with a project. Council member 18 Mueller was disappointed that fees had not been paid. 19 20 Clerk-Administrator Ericson indicated that development was approved back in 1974 and they 21 chose not to move forward with their project for a number of years. 22 23 Mayor Marty indicated that he would like to amend the Resolution to state that despite the denial 24 of the plat, the Applicant is responsible for the fees in processing this request. 25 26 Clerk-Administrator Ericson indicated that the Resolution could be amended but it is not 27 necessary, as the City has the authority to hold the Applicant responsible for fees incurred in 28 processing the request. 29 30 MOTION/SECOND: Marty/Stigney. To Waive the Reading and Approve Resolution 7256, 31 Consideration of Denial of a Rezoning and Final Plat for the Knollwood Place Townhome 32 Development on County Highway 10. 33 34 Council Member Flaherty asked what the ramifications are if this were to remain open. 35 36 Clerk-Administrator Ericson said that tabling would short circuit the process, and the Applicant 37 would not be required to go before the Planning Commission. He then said that he feels that the 38 residents should be informed of what is going on with the project as this was done two years ago 39 and the residents in the area may be different. 40 41 Council Member Mueller asked whether the property has any additional perceived value, if a plat 42 approval is pending. She said it would be appropriate to have the owner/developer come back 43 before the Planning Commission since so much time has gone by and it sounds like the project is 44 subject to change based on the current economy. 45
