Mounds View City Council April 14, 2008 <br />Regular Meeting Page 7 <br /> <br />Mr. Lillestrand said that if there is a six month extension and the property is not sold, he would 1 <br />plan to build the townhomes as approved. He then said that they have paid taxes on the property. 2 <br /> 3 <br />Council Member Flaherty indicated that the fees need to be paid. He then said that he has no 4 <br />problem with a six month delay, but that would be it. 5 <br /> 6 <br />Planner Heller indicated that the only thing that could change would be if this property were to 7 <br />sell, and then the approval process would start all over again. 8 <br /> 9 <br />Clerk-Administrator Ericson indicated that Staff’s concern is that this was applied for in 2006, 10 <br />reviewed by the Planning Commission, and Council in 2006 and this is far too long to have this 11 <br />outstanding. He then recommended a definitive action be taken at this time and move forward 12 <br />with the denial. 13 <br /> 14 <br />Council Member Mueller asked if this is the same type of situation on the townhome 15 <br />development in another area without an expiration date. Council member Mueller said she 16 <br />thought it would be better to let the rezoning/plat expire and have the owner or developer come 17 <br />back before the City when they were ready to move forward with a project. Council member 18 <br />Mueller was disappointed that fees had not been paid. 19 <br /> 20 <br />Clerk-Administrator Ericson indicated that development was approved back in 1974 and they 21 <br />chose not to move forward with their project for a number of years. 22 <br /> 23 <br />Mayor Marty indicated that he would like to amend the Resolution to state that despite the denial 24 <br />of the plat, the Applicant is responsible for the fees in processing this request. 25 <br /> 26 <br />Clerk-Administrator Ericson indicated that the Resolution could be amended but it is not 27 <br />necessary, as the City has the authority to hold the Applicant responsible for fees incurred in 28 <br />processing the request. 29 <br /> 30 <br />MOTION/SECOND: Marty/Stigney. To Waive the Reading and Approve Resolution 7256, 31 <br />Consideration of Denial of a Rezoning and Final Plat for the Knollwood Place Townhome 32 <br />Development on County Highway 10. 33 <br /> 34 <br />Council Member Flaherty asked what the ramifications are if this were to remain open. 35 <br /> 36 <br />Clerk-Administrator Ericson said that tabling would short circuit the process, and the Applicant 37 <br />would not be required to go before the Planning Commission. He then said that he feels that the 38 <br />residents should be informed of what is going on with the project as this was done two years ago 39 <br />and the residents in the area may be different. 40 <br /> 41 <br />Council Member Mueller asked whether the property has any additional perceived value, if a plat 42 <br />approval is pending. She said it would be appropriate to have the owner/developer come back 43 <br />before the Planning Commission since so much time has gone by and it sounds like the project is 44 <br />subject to change based on the current economy. 45
