The content of Resolution 7319 is based on Attachment #3 of the Work Session <br />Staff Report. A copy of Attachment #3 is included with this Staff Report for <br />reference and comparison to the proposed resolution. Given the information <br />provided in available reference documents, only a brief review of the components <br />of the proposed program for the infiltration features is given below. Following <br />that is discussion on other specific issues Council may wish to consider in regard <br />to the proposed program. <br />Proposed Program Components: <br />Standard Program – City Responsibility <br />A summary of the Standard activity of the City as part of each Street and Utility <br />Improvement Project would be to construct infiltration swales within the City <br />owned right-of-way at designated locations along the streets being reconstructed. <br />The City would restore the surface of the swales with wet-tolerant turf. <br />The swales would be owned by the City, and the City would be responsible for <br />inspection and maintenance from a storm water functionality standpoint. <br />Standard Program – Property Owner Responsibility <br />Under the program, for a Standard infiltration feature the owner of the property <br />adjacent to the feature would be responsible for ongoing, routine maintenance of <br />the turf surface of the feature. <br />Optional Improvements <br />The program would provide the opportunity for property owners to perform <br />optional improvements to the surface of the infiltration features, if they would like <br />to make them more aesthetically pleasing. The optional improvements could <br />include plantings or most other types of landscaping. <br />The optional improvements would be owned and maintained by the property <br />owner. The property owner would be responsible to initially furnish and install <br />the improvements as well. <br />The City would have the authority to ensure the optional improvements do not <br />become eyesores or some other type of nuisance. The City would also have the <br />authority prevent or remove any type of optional improvement that would <br />interfere with the storm water function of the feature. Finally, the City would have <br />the authority to displace optional improvements in the course of performing <br />necessary maintenance to ensure storm water functionality of the feature. <br />Other Issues for Discussion Regarding the Program: <br />Notification of City for Optional Improvements <br />In the course of preparing Resolution 7319, it occurred to Staff that there had <br />been no discussion on whether property owner should be required to notify the <br />City when they performed optional improvements in the infiltration swale. Given <br />the City ownership of the swales, and its responsibility for the storm water <br />function, the City may wish to be aware of the optional improvements that occur.
