Item No: 7G <br />Type of Business: Council Business <br />Meeting Date: October 13, 2008 <br />Administrator Review: _____ <br /> City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: Mike Sommer, Police Chief <br />Item Title/Subject: Consideration of Ordinance 815, an Ordinance Amending <br />Section 702.01, Subdivision 13 Relating to Crimes Against <br />Public Safety and Health <br /> <br /> <br />Background <br /> <br />The City of Mounds View prosecuting attorney advised that the above referenced section of <br />City Code does not clearly prohibit discharging a weapon or air gun in the city. To correct <br />this deficiency the prosecutor recommends adding the following phrase to Subd. 13b (2): <br /> <br />“and it shall be unlawful for any person to aim or discharge a weapon or air gun within the limits <br />of the municipality. <br /> <br />This amendment would satisfy the intention of the ordinance by prohibiting any discharge of a <br />weapon or air gun within the city limits, regardless of whether the discharge had an immediate <br />endangerment to anyone. This amendment will also allow successful prosecution of cases <br />where weapons or air guns are pointed or discharged at people, animals, houses, cars etc., <br /> <br />The City Council first considered the amendment above it its meeting on September 22, <br />2008, at which time the first reading was approved unanimously. The second reading, <br />scheduled for October 13, 2008, would result in the adoption of the amendment. Approval is <br />done by roll call vote. <br /> <br />Recommendation <br /> <br />Staff recommends approval of the second reading and adoption of Ordinance 815 as <br />presented. <br /> <br /> ___________________________ <br />Mike Sommer <br />Police Chief
