3.The property owner states their supposition regarding groundwater flow. <br />There is no evidence to support a claim that the infiltration feature will result <br />in water seepage into the basement of the home. The feature will be designed <br />to accept only a limited amount of water volume. If during a rainfall event the <br />design capacity of the feature is exceeded, the excess water will flow back <br />into the gutter of the street and will be collected by the storm sewer. Also, the <br />elevation of the feature will be designed in accordance with accepted design <br />principles in relation to the groundwater elevation. <br />4.The infiltration feature will be designed and constructed to accommodate the <br />existing power pole. City Staff has met on site with the City Forester to <br />review the pine tree. It has been confirmed that the feature can be designed <br />and constructed to avoid impact to the tree. <br />5.Property owner states their opinion regarding potential for collecting trash and <br />leaves. This is not an acceptable basis for an appeal of the SIP. <br />6.The design and construction of the features on the project will be coordinated <br />with the private utilities such as natural gas, telephone, and cable television. <br />7.The existing infiltration feature along County Road H2 was only referenced as <br />an example. It is not possible to locate a sufficient number of side yard <br />features only in the 2009-2010 SUIP and meet the requirements. Again, the <br />locations have been selected not in terms of individual “fairness”, but based <br />on where maximum overall benefit for the project & City can be obtained <br />with minimal negative impact to the existing property. <br />That being said, during the on-site meeting the Forester indicated that the <br />proposed feature could also be constructed along the side yard with no <br />negative impact to the existing trees. Staff will investigate the possibility of <br />locating the feature along the side yard, if that would be more acceptable to <br />the resident. <br />8.The property owner states their personal opinion that they do not want an <br />infiltration feature adjacent to their property. This is not suitable basis for the <br />appeal process of the SIP.
