To qualify-for-credits, the zoning and City- - - - -- <br /> -- - <br /> financial assistance must be approved. All approvals <br /> are, of course, contingent on receipt of the total <br /> amount of tax credits. <br /> 2. Conditions of the Development Agreement <br /> * Design considerations - provisions to assure the City of a quality <br /> building with additional provisions for <br /> maintenance standards. <br /> * Management considerations that provide for City approval prior to any change <br /> of management firms for the project. <br /> * Senior only clause that would provide that the development will remain low- <br /> mod income senior housing beyond the term of the TIF payback. <br /> 3. Provisions of the amended Tax Increment Financing Plan <br /> * The TIF plan that provides for the pooling of the districts will provide <br /> sufficient language to cover the development of the senior housing <br /> project. <br /> 4. Wetland delineation <br /> * The developers will commission the updated delineation of the wetland <br /> area on the site. <br /> 5. Agreement for payment of deferred fees <br /> * When Westminster first approached the Council with their proposed <br /> project one of the requests was for deferment of permit and <br /> development fees. I am seeking an agreement that will set the <br /> conditions of the payment of any deferment of fees, including attorney <br /> fees for preparation of the development agreement. <br />
