Resolution #2 : Veit has indicated that even if Kenko begins work
on the north side of TH 118 first, a cost of
$28, 000 would still be incurred by Veit for the
referenced regrading, which the City expects to be
paid by MWCC. However, since the overriding
concern is to not hinder the City' s contractor in
the completion of its work so that the City can
open its golf course in 1995 as scheduled, the MWCC
has agreed to pay reasonable regrading costs on the
tees, greens, and fairways disturbed by Kenko to
bring these areas back to current condition
including the salvaging of existing topsoil. It is
the intent of both parties to have Veit act as
subcontractor to Kenko or to have a direct
agreement between Veit and the MWCC in the
performance of this regrading work .
Issue #3 : Trees to be removed under the MWCC' s contract in
the area north of TH 118 need to be replaced.
Resolution #3 : .The MWCC will replace certain trees cleared by its
contractor, in accordance with the City' s
replacement policy. Mary Krafve will work with
Mary Saarion of the City' s Park & Rec Dept. and the
City Forester, Rick Wriskey to inventory the trees
remaining from Veit ' s clearing operations and reach
agreement regarding the number of replacement trees
to be planted.
Issue #4: Dewatering operations for the City's project are
on-going. The MWCC would Pike to sample the
dewatering discharge in order to further define the
extent, if any, of lead and silver contamination in
the groundwater.
Resolution #4: The City will grant access to the MWCC for sampling
purposes and will assist the MWCC to the extent it
can in doing the sampling/testing of the
groundwater.
cc: Ray Payne
Rich Rovang
Mary Krafve
Kyle Colvin
Eunice Groschen
Samantha Orduno
-2-
