arising from the ownership, design, operation, and <br />maintenance of the facility. The policy(ies') limits, <br />terms and conditions shall be acceptable to each party. <br />Costs of insurance shall be apportioned equally to each <br />Member Department. <br />11. Facility Use. Each Member Department shall be entitled <br />to equal use of the facility, subject to advance <br />scheduling through the Operations Committee under the <br />rules and guidelines established by the Chiefs' Board. <br />12. Use By Others. The Chiefs' Board shall establish <br />guidelines for use of the facility by others for a fee. <br />The Operations Committee shall carry out the guidelines <br />and shall be in charge of scheduling and collection of <br />rents/fees. No rental shall be scheduled so as to <br />conflict with any scheduled activity by a Member <br />Department. Any rents/fees collected in excess of <br />current year operating expenses may, at the Chiefs' <br />Board's discretion, be retained for repair, improvements <br />to the facility, future operating expenses, or returned <br />to the Member Departments. <br />13. Chiefs' Board. The Chiefs' Board shall consist of the <br />:ire Chief or the :ire Chief's designee of each Member <br />Department unless another representative is designated <br />by the City Council of a Member. The Board shall act by <br />majority vote of a quorum present at a board meeting <br />(unless unanimous approval is required by this Agreement) <br />duly called by a member of the Board upon notice given to <br />-5- <br />
