4 <br /> <br />4.8.2. Construction engineering and administration fees shall be calculated based <br />on the final contract quantities and unit prices. <br /> <br />5. Payment Schedule <br /> <br />5.1. Design engineering will be invoiced upon execution of this agreement. <br /> <br />5.2. The County will invoice the City for construction costs incurred on a monthly basis <br />or as determined by the payment schedule for the contractor. <br /> <br />5.3. Construction engineering will be invoiced at the time of substantial project <br />completion, as determined by the County. <br /> <br />5.4. Payment will be made within 30 days of receipt of an invoice. <br /> <br />6. Ownership and Maintenance Responsibility for Project Elements <br /> <br />6.1. The County shall own and maintain the roadway and associated roadway <br />elements located within the County Right of Way, except as detailed below <br /> <br />6.2. The City shall own and maintain Program Avenue and Program Connector <br />roadways and associated roadway elements. <br /> <br />6.3. The County shall own, operate, and maintain all of the components of the storm <br />sewer system including catch basins and catch basin leads except for the <br />structures and pipes labeled ‘Maintained by City of Mounds View’ as shown in <br />Exhibit B. <br /> <br />6.4. The County shall own, operate, and maintain the Program Wet Pond located <br />between Program Avenue and the I-35W southbound off ramp. <br /> <br />6.5. The City shall own, operate, and maintain the Mermaid Wet Pond located at the <br />southwest corner of County Road H and County State Aid Highway 10/Mounds <br />View Boulevard. Pond maintenance includes but is not limited to inspection, <br />cleaning, maintenance of the turf and erosion control measures around the pond <br />perimeter, and pond sediment removal as needed to perpetuate pond capacity and <br />function as designed. The County may perform maintenance and bill the City if it <br />determines that the pond basin is not being adequately maintained. <br /> <br />6.6. The County shall own, operate, and maintain the traffic signal located at the <br />intersection of Trunk Highway 10/County State Aid Highway 10/County Road H, <br />except that the City shall be responsible for maintenance of painted signal poles <br />and mast arms. The County will perform maintenance on the EVP system and will <br />bill the cost to the City. <br /> <br />6.7. The City will own and maintain the street lights.
