Mn/DOT adds traffic volume capacity to their trunk system, noise attenuation
must be provided in areas that do not meet Federal daytime noise standards (65
decibels). This is the case in the Ardan Park Area. Mn/DOT added a third
eastbound lane, thus increasing capacity. Also, the noise levels in this area are
above the Federal daytime noise standard. Therefore, moving the wall to the
LaPort Neighborhood Area is not a legal option for Mn/DOT.

Recommendation:
Staff is looking for direction on this matter. Specifically, Staff is looking for
Council direction regarding the issuance of a Zero Dollar Permit to Mn/DOT and
eventually granting fee title and an easement to Mn/DOT for City property as
shown on the permit.

Respectfully Submitted,

Greg Lee, Director of Public Works
