City Council Work Session – Item 6 <br />February 2, 2009 <br />Page 5 <br />If an Agreement form is to be developed, its parameters must be established. <br />Items that warrant discussion at this time are: <br />-Financing of the improvements <br />-Setting of fees <br />-Coordination with property owners <br />x Financing of the Improvements <br />Resolution 7338 addresses this parameter for Non-Conforming <br />Driveways. It states that the property owner will be responsible for <br />100% of the cost. <br />Staff feels that parameter could also be applied to the sanitary sewer <br />repairs, and also the installation of new sewer and water service lines. <br />Those improvements provided benefit to only a single property, and <br />are not standard benefits that are experienced by all properties within <br />the project. <br />The issue of widening a driveway within the City Code requirements is <br />not as clear. It is recommended that the City Council discuss this <br />issue and provide direction as to whether this is considered a standard <br />benefit that should be provided (financed) by the City, or if it is a <br />property-specific benefit that is to be paid for by the property owner. <br />x Setting of Fees <br />The construction contract for the 2009-2010 Street and Utility <br />Improvement Project includes specific line items for the types of <br />improvements described in this Staff Report. For example – <br />installation of water service pipe by the lineal foot; installation of <br />concrete driveway surface by the square yard. Once the construction <br />bids are received and a construction contract is awarded, the City can <br />use those costs to set fees for the work. The fees would include all <br />associated costs such as engineering, legal, inspection, testing, etc. <br />The City Council should discuss whether it prefers to set a standard <br />fee for each improvement that is adjusted annually, or whether it <br />prefers to set the fee for the work for each project area based on the <br />actual construction bids received. <br />x Coordination with Property Owners <br />If the general approach described in this Staff Report were to be <br />implemented, the City would need to coordinate with the property <br />owners to identify the work to be done. Since all improvements would <br />be private, they must be requested by the property owner. However,
